Chap. 63.—An ACT to secure for the people of Virginia benefits under Title II
of the National Industrial Recovery Act, relating to public works and con-
struction projects, thereby co-operating with the President in national re-
covery; to provide for receiving, on behalf of the Commonwealth of Virginia,
of grants and advances from the United States under the National Industrial
Recovery Act for projects for construction, repair and improvement of public
highways and bridges, and for the expenditure of same; and for the repay-
ment of advances from the motor vehicle fuel tax. [S. B. 28]

I. Be it enacted by the General Assembly of Virginia, That, in order
to co-operate with the President in national recovery and to assist the
people of Virginia to receive, as nearly as may be, the full benefits of
Title Il of the National Industrial Recovery Act, relating to public
works and construction projects, particularly the provisions thereof for
grants to the States up to thirty per centum of the cost of labor and
materials on projects for construction, repair and improvement of public
highways and bridges, the State Highway Commissioner, with the ap-
proval of the Governor, be, and he is, authorized to apply and negotiate
for, and to receive, on behalf of the Commonwealth of Virginia, grants
from the United States under Title II of the National Industrial Re-
covery Act, up to thirty per centum of the cost of labor and materials,
to be paid into the State treasury and expended under the supervision of
the State Highway Commissioner on projects for construction, repair
and improvement of public highways and bridges in Virginia.
2. That, in order to obtain the grants referred to in section one of
this act, the State Highway Commissioner, with the approval of the
Governor, be, and he is, authorized to apply and negotiate for, and to
receive, on behalf of the Commonwealth of Virginia, advances from the
United States under Title II of the National Industrial Recovery Act,
not to exceed the sum of twelve million dollars ($12,000,000.00), (in
addition to the grants provided for in section one above), to be paid
into the State treasury and expended under the supervision of the State
Highway Commissioner on projects for construction, repair and im-
provement of public highways and bridges in Virginia, and in the name
of and on behalf of the Commonwealth of Virginia, to execute such
agreements as may be required, with the United States of America, the
President, the Federal Emergency Administrator of Public Works, or
such other agency of the United States as may be necessary, in order
to obtain such advances. , ,
3. The State Treasurer shall set aside each year from proceeds of
the motor vehicle fuel tax a sum sufficient to pay interest accumulating
on the unpaid balance of the advances made by the United States, and
received by the Commonwealth of Virginia under the provisions of sec-
tion two of this act, at a rate not to exceed four per centum per annum,
as the said interest matures, and shall pay the said interest in the manner
prescribed by law for the disbursement of funds in the State treasury.
In addition to such interest, and commencing with the fiscal year start-
ing July first, ninteen hundred and thirty-six, the State Treasurer shall
set aside each year out of the proceeds of the motor vehicle fuel tax, a
sum sufficient to repay one-seventh of the total amount advanced by
the United States, and received by the Commonwealth of Virginia under
section two of this act, and shall repay the same to the United States in
the manner provided by law for the disbursement of funds in the State
treasury. The State Highway Commissioner is authorized, with the ap-
proval of the Governor, to incorporate in agreements for obtaining ad-
vances from the United States under section two of this act, covenants
on behalf of the Commonwealth of Virginia, that the motor vehicle fuel
tax, available for the payment of interest upon, and repayment of
principal of, advances obtained under the provisions of section two of
this act, will not, so long as any part of such advances remains unpaid,
be reduced to such an extent as to prevent the amount of such taxes
collectible each year and available for the payment of such interest and
repayment of the principal maturing during that year from being a sum
equal, at least, after compliance with previous obligations, to the 1n-
terest and principal maturing within one year.
Section 314. Notwithstanding any provision in the law to the con-
trary, a part or parts of the monies which may be received under this
act, may, in the discretion of the Highway Commission, be expended
upon such streets and roads of the cities and towns as are now, or may
hereafter be designated, part of the State highway system.
4. An emergency existing, this act shall be in force from its passage.
