Chap. 425.—An ACT to limit and reduce the fees, allowances, commissions, salaries
and other emoluments of office, which certain officers named in section 3516 o!
the Code of Virginia may receive for and during the year beginning January
1, 1933, and ending December 31, 1933; to require such officers to make state.
ments and reports of their collections and expenses; and to require such officers
to pay a portion of the fees, allowances, commissions, salaries, and other emolu-
ments of office collected and received by them during the said year into th

Be it enacted by the general assembly of Virginia, as follows:
1. For the year beginning January first, nineteen hundred anc
thirty-three and ending December thirty-first, nineteen hundred anc
thirty-three, every court clerk, county and city treasurer, county anc
city commissioner of the revenue, county and city sheriff, city sergeant
high constable, examiner of records and attorney for the Common-
wealth shall pay into the State treasury ten (10%) percentum of al
fees, allowances, commissions, salaries, and other emoluments of office
derived from the State or any political subdivision thereof, or from
any other source whatever, collected or received by him during the
said period, and which remain after deducting therefrom such expenses
as shall be allowed by the State fee commission, and the excess, if any,
required to be paid into the State treasury by the said officers, re-
spectively, pursuant to the provisions of sections thirty-five hundred
and sixteen, thirty-five hundred and sixteen-a and thirty-five hundred
and sixteen-b of the Code of Virginia. The amount so paid into the
State treasury pursuant to the provisions of this act, shall be distributed
as the excess required to be paid into the State treasury by the said
officers, pursuant to the aforementioned sections of the Code of Vir-
ginia, is distributed. Provided, however, that this act shall not apply
so as to require such payment to a greater extent than will thereby
reduce the aggregate net compensation of all kinds of the above men-
tioned officers, respectively, to ninety percentum of the aggregate net
compensation received by such officers respectively for the year nine-
teen hundred and thirty.
For the purpose of carrying out the provisions of this act, such
statements and reports as are required to be filed with the comptroller
by sections thirty-five hundred and sixteen, thirty-five hundred and
sixteen-a and thirty-five hundred and sixteen-b of the Code of Vir-
ginia, shall be filed by the officers named in this section of this act at
such time, in such manner and in such form as is required by the afore-
mentioned sections of the Code of Virginia.
Z. For the year beginning January first, nineteen hundred and
thirty-three and ending December thirty-first, nineteen hundred and
thirty-three, every justice of the peace, civil justice, justice of a juvenile
court, and clerk of a civil justice court shall pay into the treasury of
the county or of the city for which the said officer has been elected
or appointed, ten (10%) percentum of all fees, allowances, commis-
sions, salaries and other emoluments of office, derived from the State
or any political subdivision thereof, or from any other source whatso-
ever, collected or received by him during the said period, and which
remain after deducting therefrom such expenses as shall be allowed
by the board of supervisors of the county or council of the city for
which such officer has been elected or appointed and the excess, if any,
required to be paid into the treasury of the county or city by the said
officers, respectively, pursuant to the provisions of sections thirty-five
hundred and sixteen, thirty-five hundred and sixteen-a and thirty-five
nundred and sixteen-b of the Code of Virginia. The amount so paid
into the treasuries of the counties and cities by the said officers pur-
suant to the provisions of this act may be used by tne sald COUNENS a
cities for any purposes for which general funds thereof may be used.
For the purpose of carrying out the provisions of this act, such
statements and reports as are required to be filed with the clerk of the
circuit court of the county or of the corporation or hustings or circuit
court of the city by sections thirty-five hundred and sixteen, thirty-five
hundred and sixteen-a and thirty-five hundred and sixteen-b of the
Code of Virginia, shall be filed by the officers named in this section of
this act at such time, in such manner, and in such form as is required
by the aforementioned sections of the Code of Virginia.
3. The payments required to be made into the State treasury and
‘nto the treasuries of the counties and cities by sections one and two
of this act shall be made on or before January fifteenth, nineteen hun-
dred and thirty-four.
A. The State fee commission is hereby authorized and directed to
determine in the manner now provided by sections thirty-five hundred
and sixteen, thirty-five hundred and sixteen-a and thirty-five hundred
and sixteen-b of the Code of Virginia, the allowable expenses and the
excess, if any, to be deducted by each of the officers mentioned in sec-
tion one of this act for the year beginning January first, nineteen hun-
dred and thirty-three, so as to determine the amount to be paid into
the State treasury under the provisions of this act.
5 The board of supervisors of each county and the council of
each city is hereby authorized and directed to determine in the manner
now provided by sections thirty-five hundred and sixteen, thirty-five
hundred and sixteen-a and thirty-five hundred and sixteen-b the allow-
able expenses and the excess, if any, to be deducted by each of the
officers mentioned in section two of this act, appointed or elected for
such county or city, respectively, for the year beginning January first,
nineteen hundred and thirty-three, so as to determine the amount to
be paid into the treasuries of such counties and cities under the provi-
sions of this act.
6. In determining the allowable expenses which may be deducted
by said officers, respectively, at the end of the said year, the State fee
commission, or council, or board of supervisors, as the case may be,
shall make a reduction of ten (10%) percentum in the compensation
of all deputies, clerks and other employees whose compensation for
such period would, but for such reduction, be more than five hundred
($500.00) dollars; provided, however, that the compensation of no
such deputy, clerk, or other employee shall be reduced bv virtue of this
provision to less than five hundred ( $500.00) dollars for said period.
7 None of the provisions of this act shall be so construed or ap-
plied as to reduce the net compensation of any of the officers named in
either section one or section two of this act, to an amount less than five
hundred ($500.00) dollars for the year beginning January first, nine-
teen hundred and thirty-three.
8 The amounts required by this act to be paid into the treasury
of the State and the treasuries of the counties and cities by the officers
herein mentioned, shall be in addition to the excess fees, allowances
commissions, salaries and other emoluments of office required to be
paid by the said officers pursuant to the provisions of sections thirty:
five hundred and sixteen, thirty-five hundred and sixteen-a, and thirty.
five hundred and sixteen-b of the Code of Virginia.
