Chap. 338.—An ACT to amend and re-enact sections 1, 2, 17 and 19 of an act
entitled an act to create the Northern Virginia park and planning district; to
provide for the creation and powers of the Northern Virginia park and plan-
ning commission, including the making of a plan for the development of said
district; the regulation of the subdivision of land within said district; the
regulation of buildings in planned streets within said district; and other mat-
ters relating to the making, protecting and preserving the integrity of and
carrying out the said plan for the said district; and providing for the levying
of a tax and the expenditure thereof for carrying out the purposes of said

1. Be it enacted by the general assembly of Virginia, That sections
one, two, seventeen and nineteen of an act entitled an act to create the
northern Virginia park and planning district; to provide for the crea-
tion and powers of the northern Virginia park and planning commis-
sion, provided that the board of supervisors of Fairfax county may
exclude from the provisions of this act such areas lying within this
county as they deem advisable, including the making of a plan for the
development of said district ; the regulation of the subdivision of land
within said district ; the regulation of buildings in planned streets with-
in said district; and other matters relating to the making, protecting
and preserving the integrity of and carrying out the said plan for said
district ; and providing for the levying of a tax and the expenditure
thereof for carrying out the purposes of said commission, approvec
March twenty-fifth, nineteen hundred and thirty, be amended and re
enacted so as to read as follows:
Section 1. That the northern Virginia park and planning distric
is hereby created and established for planning purposes as hereinafte:
set forth, consisting of the following territory, to-wit: all of the city
of Alexandria, and all of the counties of Arlington and Fairfax.
By and with the consent of the northern Virginia park and plan.
ning commission and the board of supervisors of any other county
such county or part thereof may be added to and thereby embracec
within said district. The said northern Virginia park and planning
district is in this act for abbreviation called the district.
Section 2. The northern Virginia park and planning commissior
is hereby created and for abbreviation is hereinafter referred to in this
act as the commission. Subject to enlargement as hereinafter pro-
vided the commission shall be composed of three members from each
of the political subdivisions within the district. The council of the
city of Alexandria, the county board of Arlington county, and the
board of supervisors of Fairfax county, or such of said bodies as shall
have elected to become a part of said district as provided in section
nineteen of this act, shall each select one of its own members as an ex-
officio member of said commission, and shall each appoint, other than
from its membership, a member of said commission who shall be a
resident of and a qualified voter in their respective jurisdictions, and
the remaining members shall be appointed by the governor of Vir-
ginia. The first appointments shall be made within thirty days after
this act becomes effective as provided in section nineteen hereof, upon
which date the terms of office shall begin. The term of office of each
appointed member shall be four years. The term of office of each ex-
officio member shall correspond to his official tenure as member of the
city council, county board, or board of supervisors. Any vacancy shall
be filled in the same manner as the original appointment. The mem-
bers of the commission shall receive the sum of ten dollars per diem
for attending regular and special meetings of the commission, pro-
vided, that no member shall receive more than one hundred dollars in
any one year. In event that in accordance with the provisions of sec-
tion one of this act any other county, or part thereof, is added to said
district, then the membership of the commission shall be increased by
three, to be selected in the same manner as the members from the other
jurisdictions already embraced therein.
Section 17. The costs and expenses of the commission including
costs and expenses incurred in and for the making, amending and ad-
ministration of the district plan and all other costs and expenses in-
curred for and in the course of the exercise of its powers and functions
as described in this act, shall be borne by the city of Alexandria and
the counties of Arlington and Fairfax, or such of them as elect to be-
come a part of said district as provided by section nineteen of this act,
and any other county or part thereof which may come to be included
within the district, in the proportion which the assessed value ot the
real estate located within them, respectively, and within the district,
bears to the assessed tax value of all taxable real estate within the
district. Annually the commission shall certify to the governing bodies
of the respective political subdivisions within the said district, its bud-
eet for the next succeeding fiscal year, which budget shall not exceed
in the aggregate an amount equal to two cents on each one hundred
dollars of the assessed valuation of all real and personal property with-
in the district subject to local taxation. The council of the city of
Alexandria, the county board of Arlington county and the board of
supervisors of Fairfax county, or such of them as may ratify this act
as provided in section nineteen hereof, are hereby authorized and di-
rected to provide and appropriate in their respective annual budgets,
their proportionate amounts to meet the budget requirements of the
commission as hereinbefore provided. The funds so appropriated
shall be expended and disbursed by the commission by warrants upon
the treasurers of said city and counties, respectively, authorized by the
commission, signed by its chairman and countersigned by its secretary.
Section 19. This act shall take effect when ratified and approved
by the council of the city of Alexandria, the county board of Arlington
county, and the board of supervisors of Fairfax county, or any two of
said bodies, by resolutions legally adopted and spread upon their re-
spective minute books. In the event this act is approved and ratified
by only two of said political subdivisions, the territory of the political
subdivisions so ratifying and approving the same, shall comprise the
said district, until such times as other political subdivisions may elect
to become a part of said district by ratification as hereinbefore set
forth.
