Chap. 323.—An ACT to amend and re-enact sections 4, 5, 7 and 15 of an act
entitled “an act to provide a new charter for the town of Abingdon, Virginia,
and to repeal all other acts with reference thereto,” in effect January 22, 1900,
and to further amend said act by adding thereto three new sections, to be
numbered 32, 33 and 34. [S B 367]

1. Be it enacted by the general assembly of Virginia, That sections
four, five, seven and fifteen of an act entitled “an act to provide a new
charter for the town of Abingdon, Virginia, and to repeal all other acts
with reference thereto,” in effect January twenty-second, nineteen hun-
dred, and to further amend said act by adding thereto three new sec-
tions to be numbered sections thirty-two, thirty-three and thirty-four,
which amended sections and new sections shall read as follows:
Section 4. The municipal officers of said town shall consist of a
mayor, nine councilmen, a treasurer, a recorder, and a sergeant.
(a) The mayor, nine councilmen, and treasurer shall be elected by
the qualified voters in said town, and all persons qualified to vote in
said election shall be eligible to all of said offices.
(b) The sergeant and recorder shall be appointed by the council
of the town at its first meeting in September, nineteen hundred and
thirty-two. The appointments hereunder shall be made as aforesaid
and every two years thereafter.
Terms of the officers so appointed are to begin from the date of
their appointment and continue for a period of two years until their
terms of office expire or their successors appointed.
The council shall have the right of removal of said officers ap-
pointed hereunder for malfeasance or misfeasance in office but before
said removal is made the said council is to give thirty (30) days’ no-
tice of such contemplated action by it, setting forth in such notice the
cause and citing said officer in default to appear and make defense be-
fore it and shall after hearing the same enter such order of removal or
acquittal as the case demands and as provided for in ordinances en-
acted hereunder. Such officer affected by the order hereunder shall
have the right of appeal as provided for in the Constitution and statute
laws of the Commonwealth of Virginia then in force.
Section 5. The election for mayor, councilmen and treasurer shall
be held on the second Tuesday in June nineteen hundred and thirty-
two, and every second year thereafter.
Section 7. The council shall on September first, nineteen hundred
and thirty-two, and every two years thereaiter fix the salary and other
compensation of the mayor, treasurer, sergeant and such other officers
appointed and elected under this act, which salary and other compen-
sation shall not be diminished during their term of office. _
Section 15. There shall be a lien on all goods and chattels and real
estate for taxes assessed thereon from the beginning of the year for
which they are assessed. The council may require real estate returned
delinquent for the nonpayment of taxes and assessments to be sold fot
such taxes and assessments with interest at the rate of six per centurr
per annum from the time when such taxes and assessments became due
and payable and such per centum for charges as it may prescribe, suck
sale to be made in accordance with the State law.
Section 32. The recorder appointed as provided for in subsection
(b) of section four of the town charter as above shall discharge the
duties of a commissioner of revenue of the said town. He shall
issue all license certificates to all persons, firms, or corporations en-
gaging in any business which is the subject of a special or local tax,
make up the land and personal property books of the town and school
district for each fiscal year from the records of the office of the com-
missioner of revenue of Washington county as shown for such fiscal
year, and extend on said books all town and school taxes thereon, and
deliver copy of such books to the treasurer of the town on or before
the first of July in each and every year, and take an official receipt
from the treasurer for such official delivery.
Section 33. The council of said town shall have authority to pro-
vide the manner in which all local taxes and levies are to be paid, and
also to provide for penalties on unpaid taxes and licenses not in con-
flict with the Constitution and statute laws of the State of Virginia.
Section 34, All ordinances of the town of Abingdon and all acts
and parts of acts in conflict with this act are hereby repealed.
An emergency existing, this act shall be in force from its passage.
