Chap. 308.—An ACT to amend an act entitled “an act to incorporate the town of
Appalachia, in the county of Wise,” approved March 1, 1906, by enacting, and
incorporating therein, a new section to be designated as section 3-b, relating
to the appointment of a police justice for said town. [H B 408]

1. Be it enacted by the general assembly of Virginia, That an act
entitled ‘an act to incorporate the town of Appalachia, in the county
of Wise,” approved March first, nineteen hundred and six, be, and the
same is hereby, amended by enacting, and incorporating therein, a new
section to be designated as section three-b and to read as follows:
Section 3-b. The council of said town may, from time to time, in
their discretion, appoint a police justice of said town, to serve during
the pleasure of said council, who shall be clothed with all the powers
and authority of a justice in civil and criminal matters within such
town, and shall also have concurrent jurisdiction and power with the
mayor of said town to try all prosecutions, cases, and controversies,
which may arise under the by-laws and ordinances of said town, and
to inflict such punishments as are provided by law, with the right of
appeal to the circuit court in all cases, except that no appeal shall be
granted from the decision of said police justice imposing a fine for
violation of any of the ordinances or by-laws of said town for offenses
not made criminal by the common law or statute of Virginia until after
bond, with security approved by said police justice, shall be given by
the person so fined, or someone for him, with condition to pay all such
fines, costs, and damages as may be awarded by the said court on
appeal. In the event of an appeal, the proceedings are to comply with
section three thousand and eleven of the Code of Virginia. That the
council of said town may direct the payment to said police justice of
said town of a salary not exceeding fifty dollars per month, payable
as the council may direct; and that said police justice shall not receive
any compensation for his services in trying violations of the by-laws
or ordinances of said town, or for other services rendered the town,
except the salary fixed by the council and all fees for such services
rendered by him shall be paid into the treasury of the town. Said
police justice shall reside in said town and shall be an elector thereot.
This section shall apply to said town under any form of government
which said town may have lawfully adopted since March first, nineteen
hundred and six, or which it may hereafter lawfully adopt.
The appointment of said police justice shall be optional with the
town council, and, while any such justice is in office and acting, no
greater salary shall be paid to the mayor of said town than is paid to
each of the members of the council thereof.
