Chap. 293.-An ACT to amend the Code of Virginia by adding thereto a new
section numbered section 4439-a, prescribing penalties for breaking open or
opening, with intent to commit larceny therefrom, pumps, tanks and containers
used for storing or dispensing kerosene, gasoline or motor oils. [S B 213]

1. Be it enacted by the general assembly of Virginia, That the
Code of Virginia be amended by adding thereto a new section num-
bered section forty-four hundred and thirty-nine-a, which new section
shall read as follows:
Section 4439-a. If any person, with intent to commit larceny there-
from, break and open or open, any pump, tank, or other similar equip-
ment or container used for dispensing or storing kerosene, gasoline or
motor oils, he shall upon conviction be confined in the penitentiary not
less than one nor more than ten years, or, in-the discretion of the court
or jury, confined in jail not exceeding twelve months, and fined not
exceeding five hundred dollars. _
