Chap. 291.—An ACT to ratify and approve the restoration of the original build-
ings and grounds of the Colonial College of William and Mary, authorizing
their acceptance by the board of visitors of said college, and to provide for
further changes by said college in the restoration of buildings, and decorations,
furniture and furnishings, and in the landscaping of the grounds surrounding
said Colonial College of William and Mary. [S B 327]

Whereas the board of visitors of William and Mary College did on
the twenty-fourth day of February, nineteen hundred and thirty-two,
adopt the following resolutions subject to the approval of the governor
and the attorney general of the Commonwealth of Virginia, which
resolutions have by said governor and attorney general been approved,
as follows to wit:
Whereas, the board of visitors of the College of William and Mary
have deemed it desirable that the original buildings and grounds of the
colonial College of William and Mary and the surrounding grounds
of the old college triangle should be restored and preserved; and
Whereas, it has fortunately been possibie to secure for this purpose
the financial aid of Williamsburg Holding Corporation and the able
assistance of the architects and landscape architect who have been act-
ing for Williamsburg Holding Corporation in the restoration of
colonial Williamsburg ; and
Whereas, as the result of intensive research covering a period of
over two years by the College of William and Mary and the research
and record department of Williamsburg Holding Corporation, plans
for the restoration of the group of buildings in question and the sur-
rounding grounds were completed and have been approved by the
State art commission of the Commonwealth of Virginia, and the ad-
visory committee of architects and advisory committee of landscape
architects for the restoration of colonial Williamsburg ; and
Whereas, a total sum in excess of six hundred and fifty thousand
($650,000.00) dollars has been appropriated by Williamsburg Holding
Corporation toward the cost of the aforesaid plans and the carrying
out of the reconstruction and restoration work thereunder, a part of
which total appropriation still remains to be expended; and
Whereas, Colonial Williamsburg, Incorporated, is a corporation
organized under chapter one hundred and fifty-one (151) of the Code
of Virginia as a “charitable or benevolent corporation” for the pur-
pose of restoring and preserving certain properties in the city of Wil-
liamsburg as historical monuments ; and
Whereas, it deems desirable to the board of visitors of the College
of William and Mary that proper provision should be made for the
future to insure that, after completion of the restoration of the build-
ings and grounds of the colonial College of William and Mary, the
restoration should be accepted subject to the following conditions:
Whereas, the board of visitors of the College of William and Mary
is willing that the expenditures still to be made by Williamsburg Hold-
ing Corporation shall be made on the understanding that the restora-
tion when completed will be accepted subject to the conditions set
forth in the following resolutions:
Now, therefore, be it resolved that the board of visitors of the Col-
lege of William and Mary request the general assembly of Virginia to
pass an act :
First. To ratify and approve the action of the board of visitors in
providing for the restoration of the original buildings and grounds of
the colonial College of William and Mary, including among such build-
ings the main or central building known as the Sir Christopher Wren
building, the Wren outbuildings, the president’s house, the president’s
house outbuildings, Brafferton Hall, and the Brafferton Hall outbuild-
ings, under plans approved by the State art commission of Virginia.
Second. To authorize the board of visitors of the College of Wil-
liam and Mary to accept such restoration at any time, or from time to
time, when completed, subject to the condition that after the comple-
tion of such restoration no further change shall be made by the Col-
lege of William and Mary in any of the aforesaid buildings as restored,
or in the interior decorations or in the furniture or in the furnishings
thereof except by and with the consent of Colonial Williamsburg, In-
corporated, or any organization to which Colonial Williamsburg, In-
corporated, may have transferred all of its property in the city of
Williamsburg subject to the approval of the art commission as pre-
scribed by law. It being further understood that in the event the Col-
lege of William and Mary fails to secure the consent of Colonial
Williamsburg, Incorporated, the matter shall be referred to the State
art commission of Virginia, whose decision shall be final.
Third. To authorize the board of visitors of the College of Wil-
liam and Mary to accept the landscaping of the grounds surrounding
the colonial College of William and Mary at any time, or from time to
tims, when completed, subject to conditions that after the completion
of said landscaping, no further change shall be made by the College of
William and Mary in the landscaping except by and with the consent
of Colonial Williamsburg, Incorporated, or any organization or cor-
poration to which Colonial Williamsburg, Incorporated, may have
transferred all of its properties in the city of Williamsburg; it being
further understood that in case Colonial Williamsburg, Incorporated,
or any corporation to which Colonial Williamsburg, Incorporated, may
have transferred all of its properties in the city of Williamsburg de-
clines to consent to any proposed change in the landscaping of the
grounds the question of any such change shall be referred to the State
art commission of Virginia, whose decision shall be final. Now, there-
fore,
1. Be it enacted by the general assembly of Virginia, as follows:
Section 1. That the action of the board of visitors in providing
for the restoration of the original buildings and grounds of the colonial
College of William and Mary, including among such buildings the
main or central building, known as the Sir Christopher Wren building,
the Wren outbuildings, the president’s house, the president’s house
outbuildings, the Brafferton Hall, and the Brafferton Hall outbuild-
ings, under plans approved by the State art commission of Virginia,
be and the same hereby is ratified and approved.
Section 2. That the board of visitors of the College of William and
Mary be and the same hereby is authorized to accept such restoration
at any time, or from time to time, when completed, subject to the con-
dition that after the completion of such restoration no further change
shall be made by the College of William and Mary in any of the afore-
said buildings as restored, or in the interior decorations, or in the
furniture, or in the furnishings thereof, except by and with the con-
sent of Colonial Williamsburg, Incorporated, or any organization to
which Colonial Williamsburg, Incorporated may have transferred all
of its property in the city of Williamsburg, subject to the approval of
the art commission as prescribed by law. It being further understood
that in the event the College of William and Mary fails to secure the
consent of Colonial Williamsburg, Incorporated, the matter shall be
referred to the State art commission of Virginia, whose decision shall
be final.
Section 3. That the board of visitors of the College of William
and Mary be, and the same hereby is, authorized to accept the land-
scaping of the grounds surrounding the colonial College of William
and Mary at any time, or from time to time, when completed subject
to condition that after the completion of said landscaping, no further
change shall be made by the College of William and Mary in the land-
scaping except by and with the consent of Colonial Williamsburg,
Incorporated, or any organization or corporation to which Colonial
Williamsburg, Incorporated, may have transferred all of its properties
in the city of Williamsburg; it being further understood that in case
Colonial Williamsburg, Incorporated, or any corporation to which
Colonial Williamsburg, Incorporated, may have transferred all of its
properties in the city of Williamsburg declines to consent to any pro-
posed change in the landscaping of the grounds the question of any
such change shall be referred to the State art commission of Virginia,
whose decision shall be final.
2. An emergency existing, this act shall be in force from its
passage.
