Chap. 258.—An ACT to authorize the county school board of Southampton county
to expend that part of the county school levy or appropriation for public
schools derived from the town of Franklin school district through such county
school levy or appropriation, in the same manner that such county school levy
or appropriation derived from other school districts is expended. [H B 263]

Whereas, the town of Franklin constitutes a separate school district
as provided by law with a town school board of three members; and
Whereas, chapter four hundred and twelve, section six hundred
and fifty-three, of the Acts of the General Assembly of Virginia of
nineteen hundred and thirty, provides that “to such town district
operated by a school board of three members the county school board
shall pay over to the town treasurer if and when properly bonded the
amount derived from the county levy or appropriation for school pur-
poses a sum equal to the pro-rata amount from such levy or appropria-
tion derived from such town”; and
Whereas, the Southampton county school board and the Franklin
town school board deem it to be for the best interests of the public
school system of Southampton county, the board of supervisors of
Southampton county and the town commission of the town of Franklin
concurring, that the entire county school levy or appropriation be ex-
pended by the county school board for the operation of the public school
system of said county including the public schools in the town of
Franklin; now, therefore, ,
1. Be it enacted by the general assembly of Virginia, That the
county school board of Southampton county be and is hereby authorized
to expend that part of the county school levy or appropriation derived
from the town of Franklin school district in the same manner that said
school levy or appropriation derived from other school districts is ex-
pended for the public schools in the county, including the public schools
in the town of Franklin. . ,
2. Nothing in this act shall be construed to effect the status of or
interfere with the rights and duties of the school board of the town of
Franklin as prescribed by law, except as above set forth.
3. An emergency existing, this act shall be in force from its
passage.
