Chap. 237.—An ACT to authorize the State highway commissioner to re-convey
certain property in Henrico and Goochland counties acquired for State highway

purposes and not used. [S B 329]

Whereas, by deed dated April seventh, nineteen hundred and thirty,
recorded in the clerk’s office of the circuit court of Henrico county, in
deed book two hundred and forty-nine-C, page one hundred and forty-
eight, Reed Land and Investment Corporation conveyed to the Com-
monwealth of Virginia, for State highway purposes certain land in
Henrico county, therein described ; and

Whereas, by deed dated March twenty-sixth, nineteen hundred and
twenty-nine, recorded in the clerk’s office of the circuit court of Henrico
county, in deed book two hundred and fifty-two-B, page two hundred
and forty-four, the First and Merchants National Bank and Louise H.
Moore, executors of the will of Thomas L. Moore, deceased, con-
veyed to the Commonwealth of Virginia, for State highway purposes,
certain land in Henrico county therein described; and

Whereas, by deed dated February twenty-sixth, nineteen hundred
and thirty, and recorded April eleventh, nineteen hundred and thirty,
in the clerk’s office of the circuit court of Goochland county, Ada Irene
Jones, in her own right, and as trustee and executrix of the last will
and testament of John T. Jones, deceased, conveyed to the Common-
wealth of Virginia for State highway purposes certain lands in Gooch-
land county therein described.

Whereas, the land so conveyed was not used by the Common-
wealth of Virginia for State highway purposes or any other purposes
and it is not contemplated that it will be used by the Commonwealth
of Virginia for any purposes. Now, therefore,

1. Be it enacted by the general assembly of Virginia, That the
State highway commissioner be, and he is, hereby authorized and
empowered for and on behalf of the Commonwealth of Virginia, to
execute and deliver to the Reed Land and Investment Corporation,
the First and Merchants National Bank, and Louise H. Moore, execu-
tors of the will of Thomas L. Moore, deceased, and to Ada Irene Jones,
in her own right and as trustee and executrix of the last will and testa-
ment of John T. Jones, deceased, respectively, or their assigns, deeds
conveying to the said parties, respectively, or their assigns, with general
warranty of title, the strips or parcels of land so conveyed to the Com-
monwealth of Virginia, by the aforesaid deeds, provided that the afore-
said parties, or their assigns, shall first repay to the Commonwealth of
Virginia, such sums of money, if any, received by them, or any of them,
from the Commonwealth for such conveyances; and, provided, further,
that the deeds herein authorized shall not include, or be construed to
include, any part of any public highway existing prior to the time of
the delivery of the aforesaid deeds to the Commonwealth.
