Chap. 115.—An ACT authorizing the State commission on conservation and de-
_velopment to acquire by the exercise of the right of eminent domain in con-
demnation proceedings or by gift, devise, purchase or any other lawful means.
for the transfer of title, the lands described therein, for public parks or for
public park purposes. [H B 142]

Be it enacted by the general assembly of Virginia, as follows:
1. The lands situated in the State of Virginia, described in sec-
tion two (2) hereof, are hereby specifically designated and set apart
as lands suitable for use as a public park and for public park pur-
poses, and the State commission on conservation and development is
hereby expressly authorized and empowered to acquire title to said
lands or any part thereof for such use.
2. The lands in the State of Virginia herein specifically desig-
nated and set apart as lands suitable for use as a public park and for
public park purposes are as follows:
A. That tract or body of land in Westmoreland county, Virginia,
together with all waters included therein or appurtenant thereto, ap-
proximately two thousand acres (2,000) in extent, beginning at a
point on the shores of the Potomac river on the boundary line be-
tween Maryland and Virginia; thence five hundred fifty-seven degrees
and forty-five minutes west in a line with southeastern corner Har-
mony Hall house, a distance of four hundred fifty yards (450), to
road leading to Harmony Hall gate; thence along said road a dis-
tance of thirteen hundred and fifty-one yards to road leading from
Sandy Point to Tucker Hill; thence along said road in a southwesterly
direction eleven hundred and eighty yards, to intersection of road
leading to Sandy Point gate; thence south thirty-six degrees west-
nine hundred yards- to East side of Shannon branch; thence along
east side of Shannon branch and northwest Yeocomico river to north
side of Yeocomico river; thence along north side of Yeocomico river
to the line of Maryland and Virginia on the Potomac river; thence
along said line to the point of beginning.
3. Subject to the provisions of this act, the State commission
on conservation and development is hereby expressly vested with the
power of eminent domain to condemn for use as a public park or for
public park purposes, and to acquire title to all or any part of the
lands described in section two (2) hereof, including dwelling houses,
outbuildings, orchards, yards, gardens, and other improvements on
such lands, and, all or any right, title, or interest in or to all or any part
of such lands, and the improvements thereon, by the exercise of the
right of eminent domain in condemnation proceedings or by gift, de-
vise, purchase, or any other lawful means for the transfer of title;
provided, nevertheless that in acquiring title to any of the said prop-
erty by condemnation proceedings or otherwise, the commission shall
have no authority to pledge the credit of the State or to incur any
indebtedness on behalf of itself or of the State.
Title to all lands and interests in lands within the areas described
in section two (2) of this act, which may be acquired by the State
commission on conservation and development under authority of the
provisions of this act shall be held by the commission in trust for
the State of Virginia.
