Chap. 95.—An ACT to require the placing of labels showing date of shipment,
quantity, and payment of tax on all containers in which scallops are shipped ;
to fix the price of such labels; to direct the application of the funds derived
from sale of such labels; and prescribing penalties. [H B 91]

I. Be it enacted by the general assembly of Virginia, That all
containers in which scallops are shipped shall have in a conspicuous
place thereon a label, written or stamped in ink, the date of shipment,
showing the quantity contained therein, and that the tax has been paid,
which shall be affixed in such manner that when the container is
opened the label will be defaced. The labels shall be supplied by the
State health commissioner upon the payment of five cents for each
gallon of scallops, and it shall be unlawful for any person or cor-
poration to ship or offer to ship by common, or public, or private car-
rier, or for any express company, railroad company, steamboat or
any other common carrier, or any public or private carrier, to accept
for shipment or transport any scallops without such labels so attached.
Any person, firm or corporation violating the provisions of this section
shall be deemed guilty of a misdemeanor and shall be fined not less
than twenty-five dollars nor more than one hundred dollars for each
offense, and have his or their certificate of inspection from the State
health commissioner withdrawn, at the discretion of the said State
health commissioner, or his authorized agents.
All revenue derived from the five cents per gallon scallop label
sales shall be used by the State health commissioner for such office,
chemical, bacteriological and sanitary inspection work as is necessary
to enforce the two foregoing sections and other sanitary shellfish
regulations pertaining to scallop shucking plants.
