Chap. 431.—An ACT for the relief of Holt Page. [H B 332]

Whereas, on the eighth day of April, nineteen hundred and twenty-
nine, Holt Page, cashier of the Central National Bank of Richmond,
Virginia, was driving in his automobile on and along the State high-
way, known as the Richmond-Petersburg pike, at a point on said high-
way about twelve miles south of Richmond, when a tree growing
upon the right of way of said highway and weakened by decay, was
suddenly blown down and across said highway and upon the auto-
mobile in which he was riding, demolishing his automobile and seriously
injuring his head and spine; and,
Whereas, as a result of said injuries he was confined in a hospital
for several months, and has been, since the date of the accident,
totally disabled from performing any of his duties as cashier of said
bank, and has suffered a loss of salary from August first, nineteen hun-
dred and twenty-nine, to January first nineteen hundred and thirty,
and has expended large sums for medical and hospital bills amounting
in the aggregate to thirty-six hundred and thirty-nine dollars and
eighty-four cents; and,
Whereas, no action can be brought against the State for a tort of
this nature, without its consent, which consent has not been given;
now, therefore,
1. Be it enacted by the general assembly of Virginia, That there
be, and is hereby appropriated the sum of thirty-six hundred and
thirty-nine dollars and eighty-four cents, payable out of the fund in
the State treasury appropriated for the construction and re-construc-
tion of State highways, and the comptroller is hereby authorized and
directed to draw his warrant upon the treasurer of Virginia for thirty-
six hundred and thirty-nine dollars and eighty-four cents, payable to
Holt Page, in full of his claim.
