Chap. 405.—An ACT to provide for refunding to the town of Buchanan the
sum of $1,241.80, being for taxes paid into the State treasury by Buchanan
National Bank for the year 1927, which should have been paid to said
town. [H B 308]

Whereas, under the provisions of section eighteen of an act entitled
an act to raise revenue for the support of the government, et cetera,
approved April sixteenth, nineteen hundred and three, as amended by
chapter five hundred and seventy-six of the acts of nineteen hundred
and twenty-six, the proper assessing officer of the town of Buchanan
assessed upon the stockholders of Buchanan National Bank, a bank
located in said town, for the year nineteen hundred and twenty-seven,
a tax of eighty-eight cents on every cne hundred dollars of the actual
value of such stock, which said tax was duly levied by the council of
said town, for town purposes, in pursuance of a resolution unanimously
adopted by said council at a meeting held on the ninth day of August,
nineteen hundred and twenty-six, but through oversight or inadver-
tence, the minutes of said meeting failed to show a recorded vote of
the members of the council, on the question ; and
Whereas, the cashier of said bank refused to pay to the town of
Buchanan the said tax so levied against said stockholders for its
benefit, but paid the entire tax of one dollar and ten cents on each
one hundred dollars value of said bank stock, which was assessed there-
on by the commissioner of the revenue of Botetourt county, into the
State treasury, the total amount thereof being the sum of fifteen hun-
dred and fifty-two dollars and twenty-six cents, of which the said town
was justly entitled to twelve hundred and forty-one dollars and eighty
cents, or eighty per centum of the whole, by reason of which payment
into the State treasury, the said town of Buchanan was deprived of
the said sum of twelve hundred and forty-one dollars and eighty cents
of revenue to which it was justly entitled; and
Whereas, the stockholders of the said Buchanan National Bank
applied to the circuit court of Botetourt county, in the year nineteen
hundred and twenty-eight, asking to be relieved from the payment of
said tax so assessed against them by the town of Buchanan, and the
said court, for the sole reason that the minutes of the town council
failed to show a recorded vote on the question of levying said tax
relieved them from the payment of the tax so assessed against them
by the said town council of the town of Buchanan; and
Whereas, the Commonwealth does not desire to take advantage of
a technical error in the proceedings by which a tax was levied, and
thereby deprive one of her political subdivisions of revenue to which
it was justly entitled; therefore,
1. Be it enacted by the general assembly of Virginia, That there
be, and is hereby appropriated, the sum of twelve hundred and forty-one
dollars and eighty cents out of the funds in the State treasury not
otherwise appropriated, for the relief of the town of Buchanan, on
account of the grievances hereinabove set forth, and that the comp-
troller issue his warrant on the treasurer of Virginia, in favor of
the town of Buchanan, for the said sum of twelve hundred and forty-
one dollars and eighty cents.
