Chap. 376.—An ACT to amend and re-enact section 2 of chapter 2 of the
acts of assembly of 1915, entitled an act to create for the county of Norfolk
a commission of roads and bridges, and to prescribe the powers and duties
of such commission, and thereby to provide for controlling, constructing and
keeping in repair the public roads and bridges within said county, and for
acquiring, establishing, altering, and vacating roads and bridges therein;
and to repeal an act entitled an act for working and keeping in repair the
public roads in Norfolk county, approved February 18, 1890, as amended
by acts approved February 26, 1908, and March 14, 1910, respectively, and
also to repeal an act entitled an act for working and keeping in repair the
public roads in Norfolk county, approved [February 1, 1894, approved
February 1, 1915, as amended. [H B 347}

1. Be it enacted by the general assembly of Virginia, That sec-
tion two of chapter two of the acts of assembly of nineteen hundred
and fifteen, as heretofore amended, be amended and re-enacted so as
to read as follows:
Section 2. The said commission shall have the power and be
charged with the duty of controlling, supervising, managing, building,
improving and keeping in order all the public roads and bridges within
said county (not included within the corporate limits of any incor-
porated town in said county which maintains its own streets), and
as an incident thereto, any stone quarry operated by said county, and
shall make and prescribe such rules, regulations, specifications and
directions as it shall deem best for building, keeping in order and re-
pairing such roads and bridges.
As used in this act, the term “road or roads” shall be construed
to include highways, streets, avenues, and roads; and the term “bridge
or bridges” shall be construed to include bridges, viaducts and cause-
ways.
The said commission shall, in addition to its other duties under
this act, have the power and right to approve or disapprove the de-
sign and construction of all such sewerage systems, sewerage pipes and
open ditches running under or along the roads, highways and streets
dedicated to public use and under the control of said commission,
and if approved, shall supervise and regulate the construction there-
of, and when the same shall be constructed shall have the power to
establish and enforce all such rules and regulations for the operation,
preservation and maintenance of such sewerage systems, sewerage pipes
and the tapping and connections with same, as it may deem best for
the maintenance and operation of same and the protection and preser-
vation of the roads, highways, and streets, under which or along side
of which, the same may be operated, and if sufficient funds are pro-
vided for the purpose, the commission may construct, so far as the
application of such funds may permit, all such sewerage systems, sew-
erage pipe lines and open ditches as may, in its judgment, be necessary
for the preservation and maintenance of all roads, highways and streets
in said county under its control, and if sufficient funds are provided
for the purpose, may operate and maintain all such sewerage systems,
sewerage pipe lines and open ditches, but no construction work above
provided shall be carried on, or maintenance and operating expenses
continue to be incurred in connection with such sewerage systems,
sewerage pipe lines and open ditches after funds available for pay-
ment of such expenses have been exhausted by disbursement.
The commission shall operate and maintain all sanitary sewerage
systems owned by Norfolk county and pay costs and expenses out of
funds provided by order of the board of supervisors of said county,
and shall further have the power to construct and maintain all such
open drainage ditches or underground drainage pipes as may be nec-
essary to preserve the roads, streets and highways in Norfolk county,
under its control and pay all costs and expenses so incurred out of
road maintenance funds under its control. |
If at any time any privately owned sewerage pipe lines running
under or along the side of any road, street or highway, controlled by
the said commission, shall be damaged, broken, or flow of sewerage
through the same be obstructed, and notice of such condition given
the commission, it in turn shall give two days’ notice to private owners
of such sewerage system to repair such damages and remove such
obstructions, and if at the end of said two days’ notice such owners
do not commence to make such repairs or commence to remove such
obstructions and continue the same until normal conditions are restored,
the commission shall have the power to make all necessary repairs to
such pipe lines and remove all obstructions to flow of sewerage, and
the cost of same shall be borne and paid by said owners of such sewer-
age systems, and all expenses so incurred and paid by said commission
shall be a claim of debt against the said owners, who are hereby re-
quired to pay all such expenses. |
Whenever the school board for Norfolk county shall, in con-
nection with the operation of the school work of said county, and in
the preservation and protection of the school buildings and school
property, desire to construct sidewalks, sewers, storm drains, fills,
excavations, and other work of like character, it shall be the duty
of said commission to make plans and specifications for such construc-
tion work, advertise and receive bids for same, when such work is
proposed to be done under contract, and to supervise and approve all
such construction work for said school board for Norfolk county, but,
the said commission shall exercise no authority over, or in connection
with the construction of buildings of any kind properly falling under
the duties of an architect employed by said school board.
Funds for the construction of improvements of character above
described, shall be provided by the school board for Norfolk county
and no contract shall be let by the said commission, in connection with
the construction work above described, for which the school board
is furnishing funds without the approval of said board.
