Chap. 371.An ACT to amend and re-enact section 2723 of the Code of Vir-
ginia, relating to the sale, exchange and control of county property by
supervisors. [H B 317]

1. Be it enacted by the general assembly of Virginia, That sec-
tion twenty-seven hundred and twenty-three of the Code of Virginia,
be amended and re-enacted so as to read as follows:
Section 2723. The board of supervisors shall have power to sell
or exchange and convey the corporate property of the county; to pur-
chase any such real estate as may be necessary for the erection of all
necessary county buildings; to provide a suitable farm as a place of
general reception for the poor of the county, and to make such orders
as they may deem expedient concerning such corporate property as now
exists or which may hereafter be acquired; provided, that no sale “or
exchange” of such property shall be made without the approval and
ratification of such sale and exchange by an order of the circuit court
of said county or by the judge thereof in vacation, entered of record;
and the board of supervisors of any county having a poor farm may,
in its discretion, sell at public or private sale, the land and buildings
and other property constituting such poor farm, on the best terms
obtainable, and such board may, in its discretion, make sale of the
timber on such farm separate and apart from the land and buildings,
and may sell the land and buildings in lots or as a whole as to said
board may seem best, and convey the same by proper deed, to the
purchaser or purchasers thereof. The sum derived from the sale ot
sales hereby authorized shall be paid into the county treasury ; and ir
the event such poor farm be so sold, the board of supervisors shal
make proper provision for the care and maintenance of the poor of th
county in such manner as it may determine upon. It shall not be
lawful for any supervisor of the county to be personally or pecuniarily
interested, either directly or indirectly, in such sale, exchange or pur.
chase of corporate property. But this section shall not be construec
to deprive the judge of the right to control the use of the courthous«
of the county during the term of his court therein; provided that the
provisions of this section shall not repeal any special act of assembly
enacted at the session of nineteeh hundred and thirty.
