Chap. 303.—An ACT to amend and re-enact section 5352 of the Code of Vir-
ginia, providing what notice and evidence required in case of ward or insane
person before order is made authorizing proceeds of sale of real estate
of non-resident infant, insane person, or cestui que trust, invested by court,
to be transferred to foreign guardian, committee or trustee, [S B 367]

1. Be it enacted by the general assembly of Virginia, That section
fiftv-three hundred and fifty-two of the Code of Virginia be amended
and re-enacted so as to read as follows:
Section 5352. What notice and evidence required in case of estate
of ward or insane person before order of transfer is made. No such
order as is mentioned in the two preceding sections shall be made until
notice of the application shall have been published once a week for
four successive weeks in a newspaper published in the county or city
in which the petition is filed, or if there be none, then in an adjoining
county, nor until it shall be shown by authentic documentary evidence
that such foreign guardian or committee has, where he qualified, given
bond with surety, sufficient to insure his accountability for the whole
amount of the ward’s or insane person’s estate in his hands or which
will. probably be received by him as such guardian or committee, nor
until the court shall be satisfied that the removal of such money or
property from this State, will not impair the rights or be prejudicial to
the interests, either of the ward or insane person, or of any other per-
son; provided, that in any case in which it shall be made to appear to
the satisfaction of the court that the laws of the foreign State or coun-
try, in which the infant or insane person resides and the foreign guard-
lan or committee was appointed and qualified, do not provide for the
giving of a bond by the guardian or committee, the court, in its dis-
cretion, may permit the money and other estate of the infant to be
paid and delivered to such foreign guardian although he has not given
the bond required by this section.
