Chap. 298.—An ACT to amend and re-enact section 3118 of the Code of Vif
ginia, in relation to civil justice courts. [S B 345]

1. Be it enacted by the general assembly of Virginia, That section
thirty-one hundred and eighteen, of the Code of Virginia, in relation
to civil justice courts, be amended and re-enacted so as to read as
follows :
Section 3118. Clerk for civil justice——A civil justice may appoint
a clerk, who shall perform such duties as may be prescribed by said
civil justice; and the council or other governing body may authorize
the said clerk to appoint as many deputies and other clerical assistants
as may be necessary for the efficient operation of the court or courts
for which he is clerk, each of said appointments, however, and the
continuance in office of such deputies or clerical assistants to be subject
to the approval of the civil justice or civil justices, as the case may be,
under whom said clerk serves. Each of such deputies when so ap-
pointed, shall be authorized to act for the clerk, and may discharge any
of the official duties of the clerk during his continuance in office, unless
it be some duty devolving upon the clerk alone. Such clerk, deputy
clerks and other employees, whose appointment is herein provided for,
shall receive for their services such compensation as the respective city
councils or other governing bodies shall fix, to be paid out of the treasury
of such city. Said clerk and each of his deputies, if any, shall quality
before the civil justice or justices, as the case may be, by taking the
oath prescribed for State and county officers, and shall at the time they
are sworn into office, give before the civil justice or civil justices, as
the case may be, such bond as is required by section two hundred and
seventy-nine, in the penalty of not less than five thousand dollars,
which bond shall be filed with the treasurer, comptroller or other ac-
counting officer of said city, and an office for said clerk shall be pro-
vided by said city in which such court or courts are located.
2. All acts and parts of acts in conflict herewith are hereby
repealed.
3. An emergency existing, this act shall be in force from its
passage.
