Chap. 180.—An ACT to authorize the State health commissioner to convey, on
behalf of the State, to the Appalachian Electric Power Company, a certain
electric transmission line owned by the State, through which electric current
is furnished the Catawba Sanatorium. [S B 87]

I. Be it enacted by the general assembly of Virginia, That the
State health commissioner be, and he is hereby, authorized to grant by
proper deed, executed, sealed and acknowledged on behalf of the Com-
monwealth of Virginia, by himself. as such commissioner, to the Appa-
lachian Electric Power Company that certain electric transmission line,
with all poles, wires and appliances connected therewith, together with
all easements or rights of way necessary for the construction, operation,
inspection, repair and removal thereof heretofore acquired by, or owned
by and maintained at the expense of, the Commonwealth of Virginia,
in Roanoke county, Virginia, and extending from the Mason’s creek
substation between Roanoke city and the town of Salem, in a north-
westerly direction following the general course of Mason’s creek and
route twenty-two of the State highway, across the Catawba mountain,
and thence through the lands of the Catawba Sanatorium property to
the Fincastle-Blacksburg turnpike. Said commissioner is authorized
to execute said deed only in consideration and upon the condition that
said Appalachian Electric Power Company, successor to the Roanoke
Railway and Electric Company, will release and relieve the Common-
wealth of Virginia; and the Catawba Sanatorium from the obligation
heretofore existing by contract with said Roanoke Railway and Electric
Company, dated July first, nineteen hundred and twelve, and by supple-
ment thereto, dated December fifth, nineteen hundred and twenty-three,
to maintain and repair said transmission line, and that said company
or its successor will continue to supply adequate electric service to the
Catawba Sanatorium as provided in said contract, and at rates not in
excess of the rates now being charged the Catawba Sanatorium for
said service.
