Chap. 91.—An ACT to amend the Code of Virginia by adding thereto a new
section, to be numbered section 4454a, making it a misdemeanor to receive
anything of value, with intent to injure or defraud, from persons engaged in
the cultivation of the soil, under a contract for personal service, and fraudu-
lently refuse or fail to perform such service or refund the thing of value
received ; and to repeal chapter 408 of the acts of assembly of 1924.

1. Be it enacted by the general assembly of Virginia, That the

Section 4454a. If any person enters into a contract of employ-
ment, oral or written, for the performance of personal service to be
rendered within one year, in and about the cultivation of the
soil, and, at any time during the pendency of such contract,
thereby obtains from the landowner, or the person so engaged in
the cultivation of the soil, advances of money or other thing of
value under such contract, with intent to injure or defraud his
employer, and fraudulently refuses or fails to perform such ser-
vice or to refund the said money or other thing of value so ob-
tained, he shall be guilty of a misdemeanor; provided, however,
that prosecutions hereunder shall be commenced within sixty days
after the breach of such contract. |
2. Chapter four hundred and eight of the acts of assembly, en-
titled an act making it larceny to receive money or other thing
of value with intent to injure or defraud, from any persons en-
gaged in the cultivation of the soil, under a contract of employ-
ment for personal service, and fraudulently refuse or fail to per-
form such service or refund such money or other thing of value
so received, approved March twenty-first, nineteen hundred and
twenty-four, is hereby repealed.
