Chap. 84.—An ACT to amend and re-enact section 7 of chapter 273 of the acts
of the general assembly of Virginia, entitled an act to provide a charter
for the town of Lexington, approved April 28, 1874. {H B 146]

1. Be it enacted by the general assembly of Virginia, That sec-
tion seven of chapter two hundred and seventy-three of an act of
the general assembly of Virginia, approved April twenty-eighth,
eighteen hundred and seventy-four, be amended and re-enacted so
as to read as follows:
Section 7. The mavor, as chief magistrate of the corporation,
shall take care that the by-laws and ordinances of said town be
faithfully executed, and to carry into effect the powers herein
enumerated, and all other powers conferred upon the said town, or
its mayor and council, by the laws of Virginia, said mayor and
council shall have by-laws and ordinances, not contrary to the Con-
stitution and laws of this State, included in which shall be the power
to confer upon the chief of police, or other officer designated by the
council of said town, the power to adopt rules and regulations for
the control of traffic, both pedestrian and vehicular, the parking of
vehicles, and any other rule or regulation needful for the safety and
health of the citizens of said town and the protection and preserva-
tion of their property ; and to prescribe and impose reasonable fines
or penalties, or to impose imprisonment in the county jail for a
period not exceeding thirty days, or to enforce the collection of fines,
which fines, penalties or imprisonments shall be imposed or en-
forced under the judgment of the mayor or one of the councilmen
of said town. They may establish a chain gang, and may enforce
the penalties and fines, and punish such offenses by sentence to the
chain gang, or otherwise, as may be authorized by law. And the
authorities of said town may, with the consent of the board of super-
visors of Rockbridge county, entered of record, use the jail of said
county for anv purposes for which the use of a jail may be needed
by them, under the acts of the mayor and council, or of the State
of Virginia; provided, however, that in all cases where a fine is im-
posed by the mayor or any councilman exceeding ten dollars, the
party or parties so fined shall have the right to appeal to the circuit
court.
