Chap. 83.—An ACT to amend and re-enact chapter 233 of the Acts of 1901,
entitled, an act to authorize the town of Abingdon to take control of the
hall in said town, known as Temperance Hall, and to provide for repairing
and enlarging the same, approved February 15, 1901. [H B 145]

1. Be it enacted by the general assembly of Virginia, That an
act entitled an act to authorize the town of Abingdon to take con-
trol of the hall in said town, known as temperance hall, and to pro-
vide for repairing and enlarging the same, approved February
fifteenth, nineteen hundred and one, be amended and re-enacted so
as to read as follows:
Section 1. It shall be lawful for the town of Abingdon to take
control and possession of the hall in said town, known as temper-
ance hall, by taking title thereto from such person or persons as
may appear to have title thereto, and bv receiving possession there-
of from such person or persons as may be in possession thereof.
Section 2. That the council of said town shall, as soon as may be
after this act becomes a law, elect from the qualified voters of said
town a board to be known as the temperance hall board consisting
of five persons; one of whom shall be elected for a term of one
year, one for a term of two vears, one for a term of three years, one
for a term of four years, and one for a term of five vears, and as
said terms expire the successors thereto shall be elected, one each
year for a term of five years; said board to have charge and control of
said property, and manage the same; and for the purpose of repair-
ing and enlarging said hall, it shall be lawful for the council of said
town to authorize a mortgage upon said property, to be executed
by said temperance hall board (attested and signed as said council
may direct) and permit bonds to an amount not exceeding ten thou-
sand dollars, to be issued by said temperance hall board. under such
mortgage, such bonds likewise to be attested and signed as said
council may determine, to bear interest at such rate, not exceeding
six per centum per annum, as may be fixed by said council, and be
payable in such time and upon such terms as the council may deter-
mine, the interest to be paid out of the rentals derived by said tem-
perance hall board for the use of said hall; and the council shall
have authority to provide for the pavment of the interest and prin-
cipal of said bonds out of funds in the town treasury or otherwise
as it may determine.
Section 3. The council of said town, shall, by ordinances, fix
the duties and powers of said temperance hall board, and in so doing
shall provide that an annual report of the finances of said board
shall be submitted to the said council for its approval.
2. An emergency existing, this act shall be in force from its
passage.
