Chap. 77.—An ACT to aniend and re-enact an act of the general assembly
of Virginia, entitled, an act tor the protection of fish in certain streams
in Alleghany and Craig counties, approved February 26, 1926. [S B 126]

1. Be it enacted by the general assembly of Virginia, That an
act entitled an act for the protection of fish in certain streams in
Alleghany and Craig counties, approved February twenty-sixth,
nineteen hundred and twenty-six, be amended and re-enacted so as
to read as follows:
Whereas, the streams hereinafter named in Alleghany and Craig
counties are streams in which trout live and propagate and it is im-
portant to prevent the same from being exterminated by illegal fish-
ing; and,
Whereas, persons have heretofore illegally taken trout from the
said streams during the closed season, it being impossible to detect
the offenders, because they claim to be fishing for some fish other
than trout; and |
Whereas, it is deemed proper to prevent fishing in said streams
at any time, with hook and line or otherwise, except during the
open season, as fixed by law; now, therefore,
1. Be it enacted by the general assembly of Virginia, That it
shall be unlawful for any person to catch fish or to fish in, or to at-
tempt to fish in, the waters of the following streams in Alleghany
county: Blue Spring run, Castile run, Mill branch, Smith’s creek,
Simpson creek, Sharver’s run, Sweet Springs branch and Dunlap’s
creek, from the West Virginia State line to the Crow place at a point
opposite the road intersection which leads from the Crow place to
Alleghany station, Toms run, Chrysley’s run, Falling Spring branch,
Dolly Ann branch, Hayse Gap branch and Roarding Rum branch,
and the following streams in the county of Craig: Barbour’s creek
and its tributaries; Craig's creck, John’s creek and Meadow creck ;
provided, however, that nothing in this act shall prevent lawtul
fishing with hook and line in the said stream during the open season
for trout and bass as fixed by State law or by the boards ot super-
visors of the said counties, respectively. Provided, that nothing in
this act shall prevent fishing for non-game fish with hook and line
in Craig’s creek and John’s creek in Craig county during the months
ot March and April.
2. Any person violating the provisions of this act shall be guilty
of a misdemeanor and upon conviction shall be fined not less than
five dollars nor more than one hundred dollars for each offense.
3. An emergency existing, this act shall be in force from its
passage.
