Chap. 47.—An ACT to amend and re-enact section 1053 of the Code of ‘Vir-
ginia, as heretofore amended, relating to the appointment of committees, their
bonds, and when estate may be committed to a sheriff or sergeant. [H B 16]

1. Be it enacted by the general assembly of Virginia, That sec-
tion ten hundred and fifty-three of the Code ot Virginia, as hereto-
fore amended, be amended and re-enacted so as to read as follows:
Section 1053. The court making such appointment shall take
rom such committee a bond in such penalty and with such surety
sit may deem sufficient ; and where a person is found insane under
he provisions of section ten hundred and fifty, ten hundred and
fty-one and ten hundred and fifty-two, the judge of the circuit
ourt of the county or corporation or circuit court of the city of
vhich he is an inhabitant, in vacation, as well as such court, may
ppoint a committee for him, and any committee so appointed shall
e required to give a bond in such penalty and with such surety
is such court or judge may deem sufficient. If any person ap-
ointed committee of an insane person refuse the trust or fail to
ive bond as aforesaid within two months from the date of his ap-
ointment, or if no person be appointed a committee within one
nonth from the adjudication, the court, or the judge thereof, in
vacation, on motion of any person interested, may appoint some
ther person committee, taking from such committee bond as afore-
said. or shall commit the estate of the insane person to the sheriff
ot the county or sergeant of the city of which he is an inhabitant,
who shall be the committee, and he and the sureties in his official
bond shall be bound for the faithful performance of the trust. The
provisions of this chapter as to the appointment of committees of
insane persons shall apply to the appointment of committees of
epileptics, feeble-minded persons and idiots.
And all appointments made by the circuit courts of the cities
between January thirteenth, nineteen hundred and twenty, and the
date this act becomes effective, both inclusive, are hereby declared
to be valid and of full force and effect.
2. An emergency existing therefor, this act shall be in force from
the date of its passage.
