Chap. 40.—An ACT to amend and re-enact section 1030 of the Code of Vir-
ginia, as heretofore amended, relating to the appemtments of committees Tor
persons adjudged to be insane. (Hi B 21]

1. Be it enacted by the general assembly of Virginia, That sec-
tion ten hundred and fitty of the Code of Virginia, as heretofore
amended, be amended and re-enacted so as to read as tollows:
Section 1050. If a person be tound to be insane by a judge or
justice of the peace before whom he is examined, or in a court
in which he is charged with erime, the circuit court of the county
or the corporation or circuit court of the city of which he is an
inhabitant shall appoint a committee for him, and when a person
adjudged to be an epileptic and committed to a hospital or colony
18 found by the superintendent thereot after observation and exami-
nation to be insane, the circuit court of the county or corporation
or circuit court of the citv of his residence atter reasonable notice
to such person shall, on the sworn certificate of the superintendent
that such person is insane, and upon such other evidence as such
court may deem proper and require, appoint a committee for him,
When the rights of creditors will not be atfected, the committee
of any person lawfully committed to any such hospital or colony
may, atter making adequate provision for those dependent on such
person or his estate for support, apply any part or the whole of the
residue of the income from his estate to the purpose of providing
such comtorts and luxuries to such person as may be permitted by
the superintendent of such hospital or colony; and may pay the
same to the steward of such hospital or colony. The steward of
any such hospital or colony receiving money as prescribed in this
~ection shall annually on or before the first day of July, after such
sum or sums have been paid render to the committee of the afore-
mentioned person an itemized statement showing receipts and dis-
bursements of money received from such committee, accompanied
Iya certificate from the superintendent of such institution that such
expenditures were authorized by him, and that none of the expendi-
tures were for anything in the ordinary maintenance of such person,
And all appointments made by the circuit courts of the cities
between January thirteenth, nineteen hundred and twenty, and the
date this act becomes effective, both inclusive, are hereby declared
to be valid and of full force and effect.
2. An emergency existing therefor, this act shall be in force from
the date of its passage.
