Chap. 239.—An ACT to amend and re-enact sections 3613, 3615, 3625 and 3638 of
the Code of Virginia. {[H B 178]

I, Be it enacted by the general assembly of Virginia, That sec-
tions thirty-six hundred and thirteen, thirty-six hundred and fifteen,
thirtv-six hundred and twenty-five, and thirty-six hundred and
thirty-eight of the Code of Virginia, be amended and re-enacted to
read as follows:
Section 3613. Board of commissioners; their appointment, meet-
ings, quorum.—The circuit court of Elizabeth City county shall ap-
pomt three persons, only one of whom shall be a branch pilot, and
the corporation court of Norfolk city, four persons, only two of
whom shall be branch pilots, to constitute a board of commissioners
to examine persons applying for branches as pilots. The board
shall hold its meetings in the city of Norfolk, four members where-
of shall constitute a quorum. They shall have full authority to
make such rules and regulations as they may think necessary for
the proper government and regulation of pilots appointed by them,
‘0 prescribe such penalties for the violations of said rules and reg-
lations as they may deem necessary and proper, including the
ight to suspend for such time as they may prescribe, or to revoke
ntirely the branch of any pilot appointed by them; provided, how-
ver, that before inflicting any penalty for violation of such rules
nd regulations the said rules and regulations shall be printed and
copy thereof furnished to each of the pilots to whom branches
ave been granted by said board, and that before any trial for viola-
on of such rules and regulations shall take place, due notice shall
e given of the time and place of trial and of the rule or regulation
leg’ed to have been broken.
Section 3615. Examination of pilots; their bonds, renewal of
‘anch.—Every person applying to the board to be examined, shall
‘oduce a certificate of the circuit court of the county or corpora-
on court of the city in which he resides, that he is of honest de-
eanor, and a citizen of the State, and furnish proof of his having
rved as apprentice to some pilot of the State for five years. If
e board find him qualified to act as a pilot they shall issue to him
certificate to that effect, and he shall thereupon become a State
icer, to be known as a branch pilot, to hold office as such for one
ar next ensuing; but before he shall perform any of the duties of
_oftice he shall give bond before the clerk of the circuit court of
‘county or the clerk of the corporation court of the city in which
resides in the penalty of five hundred dollars, conditioned for
- faithful performance of his duties as such, and there shall be

Upon the issue of the original certificate and each renewal thereof,
he shall pay to the board the sum of fifty-five dollars, which amount
the board shall deposit to its credit in bank. Within ten days after
each of such amounts is paid, the board shall render a detailed
statement to the State comptroller and shall at the same time remit
by check, direct to the treasurer of Virginia, the sum of fifty dollars
out of each of said payments. No State, city, town or county li-
censes shall be assessed against any pilot to whom a certificate is
issued under this section.
Section 3625. Signal for pilot—The master of any vessel want-
ing a pilot for any port in this State, shall signify it by a signal at
the foremast or foretopmast head; whereupon a pilot shall repair
to and pilot said vessel. The master, agent or consignee of any
vessel outward bound, or transferring between points above Old
Point Light, bearing north-northwest, shall give at least two hours’
notice to either the Norfolk or Newport News pilot officers of the
time of being ready to sail for sea or transferring.
Section 3638. Notice required before entry of judgment.—But
no judgment shall be entered, unless due notice be given of the
time and place of trial, and of the claim or charges to be preferred;
and where the charge is against the pilot for neglect of duty or
violation of law, such judgment shall in no case be for a longer
suspension of the branch of the accused than twelve months, nor
less than one month, at the discretion of the commissioners, unless
where a longer time is expressly prescribed in the rules adopted by
the board of commissioners as provided for in section thirty-six
hundred and thirteen, as amended.
