Chap. 124.—-An ACT to amend and re-enact an act entitled an act for the pro-
tection of fish in Buchanan county, approved February 25, 1922, as amended
and re-enacted, and to provide for the protection of fish and game in said
county, approved March 20, 1923, relating to protection of fish, squirrels
and raccoons. {fl B 121)

1. Be it enacted by the general assembly of Virginia, That an
act entitled an act for the protection of fish in Buchanan county,
approved February twenty-fifth, nineteen hundred and twenty-two, as
amended and re-enacted and providing for the protection of fish and
game in said county, approved March twentieth, nineteen hundred and
twenty-three, be amended and re-enacted so as to read as follows:
Section 1. It shall be unlawful for any person to take, catch or
destroy in any of the waters of Buchanan county any fish between the
first day of January and the first day of July following.
Any person violating the provisions of this section shall, upon con-
viction, be fined not less than five dollars nor more than twenty-five
dollars.
Section 2.—It shall be unlawful to use fish berries, lime, giant
powder, dynamite, guns or any explosive or chemical substance of any
kind for the destruction, taking or catching of fish in any creek, pond,
river or waters of Buchanan county at any time.
Any person violating the provisions of this section shall, upon con-
viction, be fined not less than fifty dollars nor more than two hundred
and fifty dollars, or be confined in jail for a period of not less than
fifteen nor more than sixty days, or both.
Section 3. It shall be unlawful for any person to catch or take any
fish in any of the waters of Buchanan county by means of drag seines
or tramel nets of any kind.
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than twenty-five dollars nor more
than one hundred dollars, or confined in jail for a period of not less
than ten nor more than thirty days, or both.
Section 4. It shall be unlawful to hunt or trap any squirrel in
Buchanan county between January the first and September the fif-
teenth following; and it shall be unlawful for any person to catch or
kill more than ten squirrels in one day.
Section 5. It shall be unlawful to hunt or trap any raccoon in
Buchanan county between the first day of February and the fifteenth
day of November following. .
Any person violating any of the provisions of sections four and five
of this act shall, upon conviction, be fined not less than ten dollars
nor more than fifty dollars. |
Nothing in this act shall be construed as prohibiting the depart-
ment of game and inland fisheries in operating’in any manner in a
scientific way or for replenishing the streams or diminishing the carp
or other undesirable fish.
Section 6. To hunt or trap as used in this act. Includes pursuing,
shooting, killing, capturing, trapping, snaring and netting wild animals,
and lesser acts, such as wounding, placing, setting, drawing or using
any net or device to hunt or trap wild animals, whether they result in
taking or not; includes also any attempt to hunt or trap wild animals
and any act of assistance to any other person in hunting or trapping
or attempting to hunt or trap wild animals, provided that whenever
hunting or trapping is allowed by law reference is made to so doing
by lawful means and in a lawful manner,
Section 7, That it shall be lawful to use a wire, cord or box set-
net, with mesh not smaller than one inch and without wings, for the
purpose of catching sucker and cat fish at any season of the year in
any of the waters of Buchanan county; provided, however, that any
person using such set-net shall first obtain a resident hunting or fish-
ing license for Buchanan county and provided further, that this act
shall not apply to non-residents of the State.
