Chap. 109.—An ACT to authorize the board of supervisors of the county of
Tazewell to levy a district school tax. [H B 188]

1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of the county of Tazewell be, and they are
hereby, authorized and empowered to increase the total school
levy, in said county, for all purposes not to exceed one dollar and
seventy-five cents on the one hundred dollars of the assessed
value of the property in said county, subject to taxation for local
purposes, the tax derived from such levy to be apportioned and
expended by the local school authorities of said county in the es-
tablishment and maintenance of the schools thereot, as in their
judgment the public welfare may require. The levy, herein au-
thorized, shall not, however, be laid until a majority of the quali-
fied voters of the county of Tazewell shall approve the same at an
election to be held upon that question.
2. As soon as practicable, after this act becomes effective, the
circuit court of Tazewell county, or the judge thereof in vacation,
shall enter an order requiring the judges of election at a time to
be fixed by the court or judge, not less than fifteen days from the
date of such order, which shall be designated therein to open a
poll and take the sense of the qualified voters of the county on the
question whether the total school levy in Tazewell county shall be
increased, as authorized by this act.
3. The regular election officers of Tazewell county, at the time
designated in the order authorizing the vote shall open polls at
the various voting places in the county and shall conduct such
election and close the polls in such manner as is provided by the
law in other elections. It shall be the duty of the regular election
ofhcers to prepare the ballots and otherwise provide for the sub-
mission of the said question to the voters at the said election. On
each ballot shall be printed on separate lines the following:
For raise of the local school levy.
Against a raise of the local school levy.
Voters desiring to vote in favor of the raise in said levy shall
strike out the words “against a raise of the local school levy,” and
voters desiring to vote against a raise in said levy, shall strike out
the words “for raise of the local school levy.” Voters striking
out the words “for” or “against” shall be deemed to have stricken
out or erased the entire line. The judges of election at the sev-
eral voting places shall immediately after the closing of the polls
at each of the said places count the ballots deposited and shall,
within two days after said election, make return thereof as is
provided in other elections.
4. The votes cast at such election shall be canvassed by the
election commissioners and the result thereof certified to the board
of supervisors of Tazewell county, who shall be governed by the
result thereof.
5. An emergency existing, this act shall be in force from its
passage.
