Chap. 77.—An ACT for the protection of fish in the waters of Tazewell
county. [fH B 47]
Approved February 27, 1926.
1. Be it enacted by the general assembly of Virginia, That it
shall be unlawful for any person to catch, take, or kill any fish of any
kind whatsoever in any of the streams and watercourses of Tazewell
‘county, except with single hook and line or hook with artificial bait;
provided, that German carp may be taken or killed at any time and
in any manner except by use of high-powered guns or explosives or
chemical substances. .
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than twenty dollars ($20.00) nor
more than one hundred dollars ($100.00) and be imprisoned in jail
until the fine is paid, but not exceeding thirty days, and forfeit any
and all contrivances employed by him in such violation.
2. It shall be unlawful to use fish berries, lime, carbide, dynamite,
giant powder, high-powered guns or other chemical or explosive sub-
stances of any kind for the destruction, taking or catching of fish in
any creek, pond or river in Tazewell county at any time.
Any person violating any of the provisions of this section shall,
upon conviction, be fined not less than one hundred dollars ($100.00)
nor more than five hundred dollars ($500.00) and confined in jail for a
period of not less than thirty days nor more than ninety days.
3. It shall be unlawful for any person to take from the streams
of Tazewell county any species of black bass between the first day of
January and the first day of July following; or any brook or mountain
trout or rainbow or California trout between the first day of August
and the first day of April following.
Any person violating any provisions of this section shall, upon con-
viction, be fined not less than fifty nor more than two hundred dol-
mi “i imprisoned in jail not less than ten nor more than thirty days,
or both.
4. The possession of any fish caught in violation of thisact shall
be considered as prima facie evidence of the violation of this act; and
any person reporting a violation of this act shall, upon the guilty
person’s arrest and conviction thereof, be entitled to one-half of the
fine when collected.
5. All acts or parts of acts relating to the taking, catching, or
destruction, of fish, in Tazewell county, in conflict with any of the
provisions of this act are hereby repealed.
6. An emergency existing, this act shall be enforced from its pas-
sage.
