Chap. 48.—An ACT to amend and re-enact section 2 of the special road law of
Wythe county, approved March 23, 1920, so as to allow the board of super-
visors to contract with the several members of said board to inspect certain
road and bridge maintenance and construction and to compensate them
therefor. a [H B 26]
Approved February 26, 1926.
1. Beit enacted by the general assembly of Virginia, That section
two of the special road law of Wythe county, approved March twenty-
third, nineteen hundred and twenty, and being chapter four hundred
and thirty-five of the acts of assembly, Virginia, nineteen hundred and
twenty, be amended and re-enacted so as to read as follows:
Section 2. When any person or persons appear before the board
of supervisors of the county of Wythe and deposit a sum of money not
exceeding five thousand dollars, or present to the said board of super-
visors a bond payable to the said county with approved security in
an amount double the sum subscribed (provided, however, that the
amount of the said subscription does not exceed five thousand dol-
lars), which sum deposited or subscribed as aforesaid is pledged to be
used for the purpose of grading, improving and macadamizing any
public road or part thereof in the said county, or for the purpose of
erecting a bridge as a part of any public road in the said county, the
said board of supervisors are hereby authorized, in their discretion,
to appropriate out of the county road funds, not otherwise appro-
priated, an amount equal to the amount so deposited or subscribed
as aforesaid to be used for the purposes aforesaid. Such sums and
appropriations shall be expended upon the order of the board of super-
visors, and the said work shall be done under the supervision of the
county road superintendent or other person in charge of such road
work. The funds so deposited or subscribed, as aforesaid, shall be
turned over to the county treasurer who shall place the same to the
credit of the county road funds, and his compensation for receiving
and disbursing the amount so deposited, or subscribed, as the case
may be, shall be one-half of one per centum thereof; and, provided,
further, that for the expenditure of any such funds, and for the expen-
diture of the gas tax money and the State aid money, in the several
districts of the said county, where the maintenance and construction
is not let to contract, the board of supervisors may contract with the
supervisor of the district in which it is to be spent, to personally in-
spect and superintend the said work and pay him therefor a sum not
exceeding six dollars per diem.
2. An emergency existing, this act shall be in force from its pas-
sage.
