Chap. 378.—An ACT for the relief of the members of the board of supervisors
of the county of Fauquier. ([H B 110]
Approved March 24, 1926.
Whereas, in the year nineteen hundred and twenty-one, William
Horgan, then Commonwealth's attorney for the county of Fauquier,
became short in his accounts as agent of the board of supervisors of
the said county for the handling of the Centre district sinking fund;
and,
Whereas, on account of such shortage, and by reason of the fact
that the said Horgan was not bonded, the members of the board of
supervisors of such county have borrowed money from the Fauquier
National Bank, on their personal notes to the amount of one thousand
one hundred and ninety-seven dollars and eighty-two cents ($1,197.82),
with interest from July first, nineteen hundred and twenty-five,
which money so borrowed was paid to the credit of the Centre district
sinking fund; and,
Whereas, there is still remaining due from the said Horgan, on
account of the shortage of the said Horgan the additional sum of
three hundred and forty-nine dollars and ninety-five cents ($349.95),
for which the members of the board of supervisors also consider
themselves personally liable; now, therefore, .
1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of the county of Fauquier be, and it is hereby
authorized, to pay out of the funds in hand or to come in hand in the
said Centre district sinking fund the above sum of one thousand one
hundred and ninety-seven dollars and eighty-two cents, with interest
thereon from the first day of July, nineteen hundred and twenty-five,
until paid, to take up the personal notes of the members of the board
of supervisors at the Fauquier National Bank, as aforesaid.
2. That the members of the board of supervisors of the county
of Fauquier be, and they are hereby, relieved of all personal liability
for the sum of three hundred and forty-nine dollars and ninety-five
cents ($349.95), as aforesaid, including accrued interest, and that all
claims of the county of Fauquier against them on account of the said
liability be, and the same are hereby, extinguished.
3. An emergency existing, this act shall be in force from its
passage.
