Chap. 357.—An ACT to provide for co-operative road construction between the
county, magisterial districts and citizens of the county of Campbell. [H B 360]
Approved March 24, 1926.
1. Beit enacted by the general assembly of Virginia, That when-
ever any citizen or aggregation of citizens of any magisterial district
of the county of Campbell, shall desire to build or improve any road
of such district which is included in and a part of what is known as
the county system, as designated under the provisions of the act of
assembly, approved March, nineteen hundred and eighteen, or any
material section of such road, such citizen or citizens may petition
the board of supervisors, setting forth in such petition the road or
section of road which it is desired shall be built or improved, and
their estimate of the cost of such construction or improvement, to-
gether with any facts as to the necessity for such construction or
improvement as affecting the locality wherein such road is located,
or the county at large.
2. Upon the presentation of such petition, it shall be the duty
of the said board of supervisors to notify the State highway depart-
ment of the petition to construct or improve such road, and lay before
the said State highway department such information as has been
presented to said board of supervisors touching the importance and
necessity for such immediate improvement or construction. If such
construction or improvement be approved by the said State highway
department, the board of supervisors may, in their discretion, under-
take such construction or improvement whenever the following terms
and conditions have been complied with:
Whenever any such citizen or aggregation of citizens, as aforesaid
have paid, or secured to be paid into the county treasury on demand
of the board of supervisors, into a fund to be known as the co-operative
road construction fund, an amount equal to one-third of the estimated
cost of construction of any such road project, and the district road
board has likewise paid into the county treasury a like sum, equal to
one-third of the estimated cost of construction of such project, or
whenever the said district road board and any citizen or aggregation
of citizens together have paid into the county treasury, or secured to
be paid upon the demand of the said board of supervisors, a sum
equal to two-thirds of the estimated cost of construction of such road
project, then the said board of supervisors shall appropriate out of the
county road fund a sum equal to one-third of the estimated cost of
construction of such project, and proceed to construct or improve
such road or section of road in the same manner as is provided by law
and the regulations of the State highway department for the con-
struction of State aid roads. And it is further provided that whenever
any citizen or aggregation of citizens and the board of supervisors
have jointly agreed to pay into said co-operative road fund an amount
equal to two-thirds of the estimated cost of such road project the
district road board shall, out of the district road fund, be required to
appropriate and pay into the said county treasury to be applied to
said co-operative construction fund the other one-third of the esti-
mated cost of such project, which the said board of supervisors shall
proceed to construct as aforesaid.
