Chap. 347.—An ACT to amend and re-enact section 58 of an act entitled an act
to incorporate the city of Newport News, in the county of Warwick, and to
provide a charter therefor, as amended and re-enacted by an act approved
March 24, 1920, by adding thereto subsection “k,” regulating the manage-
ment of its waterworks. [H B 527]

1. Beit enacted by the general assembly of Virginia, That section
hfty-eight of an act entitled an act to incorporate the city of Newport
News, in the county of Warwick, and to provide a charter therefor,
as amended and re-enacted by an act approved March twenty-fourth,
nineteen hundred and twenty, by adding thereto subsection ‘‘k,”’
regulating the management of its waterworks, be amended and re-
enacted so as to read as follows:
Section 58. The city manager shall be responsible to the council
for the efficient administration of all affairs of the city. He shall
have power, and it shall be his duty:
(a) To see that all laws and ordinances are enforced.
(b) Except as otherwise provided in this act, to appoint all
heads or directors of departments, and all subordinate officers and
employees of the city in both the classified and unclassified service,
with the power to discipline and remove any officer or employee so
appointed; and in the classified service all appointments and removals
to be subject to the civil service provisions of this act. Such appoint-
ments and removals shall be reported to the council at its next regular
meeting.
(c) To exercise supervision and control over all departments and
divisions created herein, or that may be hereafter created by the
council.
(d) To attend all regular meetings of the council, with the right
to take part in the discussion, but having no vote. He shall be en-
titled to notice of all special meetings.
(e) To recommend to the council for adoption such measures as
he may deem necessary or expedient.
(f) To see that all terms and conditions imposed in favor of the
city, or its inhabitants, in any public utility franchise are faithfully
kept and performed; upon knowledge of any violation thereof, to call
the same to the attention of the council and of the city attorney. It
shall be the duty of the city attorney forthwith to take such steps as
are necessary to protect and enforce said terms and conditions.
(g) To make and execute all contracts on behalf of the city, ex-
cept as may be otherwise provided in this act by ordinance, passed
in pursuance thereof.
(h) To act as budget commissioner, and as such to prepare and
submit to the council the annual budget, after receiving estimates
made by the heads or directors of the departments, or of any board
or commission not within a department.
(i) To keep the council at all times fully advised as to the financial
conditions and needs of the city.
(j) To perform all such other duties as may be prescribed by law,
or be required of him by ordinance or resolution of the council.
(k) Provided that in the event that the city shall, by purchase
or otherwise, acquire waterworks plant and system for the supply of
water to its inhabitants, the city council, in its discretion, may provide
by ordinance for the establishment of a commission, the members of
which shall be selected in any manner desired by said council, which
commission shall be vested with such powers as to the management
of said waterworks system, including the fixing of rates therefor as
said council may deem proper.
2. An emergency existing, by reason of the fact that the city is
negotiating for the immediate purchase of waterworks, this act shall
be in force from its passage.
