Chap. 337.—An ACT to provide how deeds, gifts, devises and bequests to
Jackson Memorial Hospital, of Lexington, Virginia, construed. [H B 257]
Approved March 24, 1926.
Whereas, the Mary Custis Lee Chapter, United Daughters of the
Confederacy is a non-stock corporation duly chartered under the
laws of Virginia for charitable and other purposes; and,
Whereas, the said chapter is the sole and complete owner of a
hospital located in the town of Lexington, Virginia, and known
and designated as the “Jackson Memorial Hospital,’’ said hospital
consisting of the former residence of Stonewall Jackson; and,
Whereas, the public are apt to believe, and generally do believe
that the Jackson Memorial Hospital is a separate and distinct cor-
poration and organization, and devises and bequests have been and
may hereafter be made in the name of the Jackson Memorial Hos-
pital which might fail for lack of sufficient legal designation of the
beneficiary, and it being desirable to avoid thereby the loss of any
gifts, devises, bequests to the Jackson Memorial Hospital; therefore,
1. Be it enacted by the general assembly of Virginia, That
any gift, deed, devise or bequest which may be hereafter made to
and in the name of the Jackson Memorial Hospital and intended for
the use and benefit of the Jackson Memorial Hospital at Lexington,
Virginia, owned and operated by the Mary Custis Lee Chapter,
United Daughters of the Confederacy, shall be taken, deemed and
construed to all legal intents and purposes as a gift, devise, deed or
bequest to the Mary Custis Lee Chapter, United Daughters of the
Confederacy, at Lexington, Virginia, to be taken and held by the
said chapter for the use and benefit of the said Jackson Memorial
Hospital and to be applied for such use and benefit as may be desig-
nated in any such gift, deed, devise or bequest; and the courts of this
Commonwealth shall so construe any such gift, deed, devise or
bequest.
2. In view of the fact that there might be gifts, deeds, devises
or bequests made and executed and taking effect at any time, an
emergency is declared to exist and this act shall take effect from its
passage.
