Chap. 296.—An ACT to amend and re-enact section 3146 of the Code of Vir-
ginia, in relation to the commission of fisheries. [S B 261]
Approved March 24, 1926.
1. Be it enacted by the general assembly of Virginia, That
section thirty-one hundred and forty-six of the Coce of Virginia be
amended and re-enacted so as to read as follows:
Section 3146. Commission of fisheries; members; how ap-
pointed; terms of office—For the purpose of enforcing the laws
relating to the fisheries of Tidewater Virginia, the commission of
fisheries heretofore created, shall consist, as at present, of five mem-
bers appointed by the governor, at least two of whom shall be from
Tidewater section of the State.
One of said Tidewater members shall be designated by the governor
as commissioner of fisheries, who shall be ex-officio chairman of the
commission of fisheries, and chief inspector, and one other Tidewater
member shall be designated shell fish commissioner and shall be
assistant commissioner of fisheries, assistant chief inspector and ex-
officio secretary of the commission.
The commissioner of fisheries and the shell fish commissioner
shall be, one from that section of Tidewater which lies east of the
Chesapeake bay, and the other from that section of Tidewater which
lies west of said bay.
The terms of office of the commission of fisheries shall be as
follows:
The commissioner of fisheries, for a term of four years from the
first day of July, nineteen hundred and twenty-six; the shell fish
commissioner for a term of four years from July first, nineteen hun-
dred and twenty-four, at the expiration of which term his successor
shall be appointed for a term of two years; and the remaining three
members for a term of four years each from July first, nineteen
hundred and twenty-six; so that the terms of office of all members of
the commission of fisheries shall expire July first, nineteen hundred
and thirty, and thereafter their successors shall be appointed by the
governor for a term of four years each.
The governor shall have power to remove any, or all of them,
for malfeasance, misfeasance or neglect of official duty, and to fill
any vacancy or vacancies which may occur.
All members of the commission shall be sworn into office in the
presence of the secretary of the Commonwealth, who shall there-
upon issue to each of them their commission as such, designating the
commission of fisheries and the shell fish commissioner, said com-
missions to bear the signature of the governor, countersigned by the
secretary of the Commonwealth under the seal of the State.
The commissioner of fisheries and the shell fish commissioner shall
each enter into bond in the penalty of five thousand dollars with
surety to be approved by the governor payable and conditioned as
required by section two hundred and seventy-nine of the Code of
Virginia.
All members of the commission shall be paid their actual expenses
incurred in the performance of their duties. The salaries of the mem-
bers of the commission shall be as follows:
The commissioner of fisheries, four thousand dollars per annum,
payable monthly; the shell fish commissioner, eighteen hundred
dollars per annum, payable monthly; each of the other three mem-
bers of the commission shall receive ten dollars per day for each
day they are actually engaged in the performance of their duties
as such, not to exceed, however, the sum of two hundred and forty
dollars each per annum.
2. This act shall be in force on and after July first, nineteen
hundred and twenty-six.
