Chap. 235.—An ACT to provide that officers making arrests, searches or seizures
on the public roads or highways of this State shall, in order to obtain any
fee therefor, be dressed at the time of such arrest, search or seizure in a
uniform; to prescribe the uniform to be worn, and to prevent the taxing or
collection of any fees, mileage, attendance, pay or any other charge, com-
pensation or reward for arrests or prosecutions where the arrest, search or
seizure was made on a public road or highway by.an officer not wearing the
uniform prescribed by this act. [S B 269]

1. Be it enacted by the general assembly of Virginia, That all
officers except sheriffs and their deputies, whose duties are to make
arrests acting under the authority of any law of this State or any sub-
division thereof, who shall make any arrest, search or seizure on any
public road or highway of this State shall to obtain any fee therefor,
at the time of such arrest be dressed in a uniform which will clearly
show him to casual observation to be an officer.
The attorney-general and State highway commission shall, in
conformity with the provisions of this act, designate the type of uni-
form to be worn by such officers and shall give notice of same to the
sheriff of each county and the sergeant of each city in Virginia.
Any such officer making an arrest, search or seizure when not so
uniformed shall not receive, nor shall there be taxed for his benefit
against this State or any subdivision thereof, or against any defendant,
any fee, mileage, attendance, pay or any other charge, compensation
or reward which inures to the benefit directly or indirectly of said
officer, which he otherwise would be entitled to receive. This act
shall not apply to officers making an arrest, search or seizure when
there is a uniformed officer present at the time of the arrest. But
nothing herein contained shall apply to the fixed salary or compensa-
tion of any said officer. But nothing in this act shall render any such
arrest, search or seizure unlawful.
It shall be unlawful for any person, not such an officer, as is re-
ferred to in this act, to wear any such uniform as is designated. Any
violation of this paragraph shall be punished by a fine not exceeding
five hundred dollars, or confinement in jail for a term not exceeding
twelve months, or both such fine and imprisonment.
2. All acts and parts of acts, in conflict with this act, are hereby
repealed.
