1. Be it enacted by the General Assembly of Virginia, That the
public taxes and arrears of taxes, due prior to the first day of March.
in the year nineteen hundred and twenty-seven, and nineteen hundred
and twenty-eight, respectively, as well as the revenue derived from all
sources, and all money not otherwise appropriated which shall come
into the State treasury prior to the first day of March, nineteen hun-
dred and twenty-seven, and the first day of March, nineteen hundred
and twenty-eight, respectively, shall establish a general fund, and be,
and the same is hereby appropriated for the years to close on the
twenty-eighth day of February, nineteen hundred and twenty-seven.

Out of this appropriation shall be paid the salaries of
members, clerks, assistant clerks, officers, pages and employees;
the mileage of members, officers and employees, including the
salaries and mileage of members of legislative committees sit-
ting during recess; and the incidental expenses of the Gencral
Assembly, not exceeding the sum of five thousand dollars each
for the Senate and House of Delegates.
It is further provided that out of this appropriation there
shall be paid to the Clerk of the Senate, the Clerk of the House
of Delegates, for that period for which their compensation for
services is fixed by law in connection with the present and sub-
sequent sessions of the General Assembly, twelve dollars
($12.00) per day, a sum sufficient; to the Clerk of the House of
Delegates, ten dollars ($10.00) per. day, a sum sufficient; and
to the document clerk and librarian of the Senate the sum of
seven dollars ($7.00) per day, except during the sessions of the
General Assembly, when he shall receive the sum of eight
dollars per day ($8.00), and his office shall be open every day,
except Sundays and legal holidays, as required by law, a sum
sufficient.
It is further provided that out of this appropriation there
is hereby appropriated :
payment for a voting machine for use in the hall of the

shall not be paid unless and until the Governor, Speaker of
the House of Delegates shall certify to the Auditor of Public

hereby appropriated, if and when paid, shall be paid out of any
funds in the State treasury not otherwise appropriated, on
warrant of the Auditor of Public Accounts issued on the

Out of this appropriation shall be paid to each pensioner
in the several classes now on the pension roster or hereafter
placed on the pension roster, who is cntitled, under the act to
appropriate public revenue, approved March 8, 1924 (Acts of
Assembly, 1924, chapter 122, page 148-241), to $260.00 a year
for total blindness, $270.00 a year; to $140.00 a year for total
disability, $150.00 a year; to $110.00 a year for partial dis-
ability, $120.00 a year; and to each widow of a soldier, sailor
or marine who was married prior to December 31, 1882, and
who is otherwise entitled under this act to $80.00 a year, $90.00
a year, and to the personal representative of each deceased
pensioner $25.00 for the funeral expenses of such deceased
pensioner, provided, however, that the said sum of $25.00 may
be paid without the qualification of a personal representative
to the undertaker, when such undertaker shall file his bill,
verified by proper affidavit, with the Auditor of Public Ac-
counts, together with copy of death certificate of such pensioner,
and the other allowances as authorized by the act aforesaid;
provided, further, that under the provisions of this act any
person who actually accompanied a soldier in the service and
remained faithful and loyal as the body servant of such
soldier, or who served as cook, hostler or teamster or who
worked on breastworks under command of the army and
thereby rendered service to the Confederacy shall be entitled
to receive an annual pension of twenty-five dollars, proof of
service to be prescribed by Auditor of Public Accounts..
It is provided, however, that if any assessment hereafter
made of the real estate or personal property, or both, owned at
this time by a pensioner on the pension roster shows an in-
creased valuation beyond the amount fixed by law to entitle a
pensioner to draw a pension, such increase shall not operate to
prevent any such pensioner from recciving the pension he shall
receive under the provisions of the said act approved March
8, 1924; provided, further, that if the property held, as here-
inbefore provided, by a Confederate soldier, his wife or widow,
assessed at $2,000.00 or more, yield a total income less than
$300.00, including income from all sources, such applicant shall
not be denied the benefit of the pension under this section.
It is further provided that the Auditor of Public Accounts
shall not use any part of this appropriation for clerk hire,
expenses, etc.
And it is further provided that out of the appropriation for
public printing, the Superintendent of Public Primting shall
supply all forms and have done and pay for all printing, bind-
ing, ruling, etc., required by the Auditor of Public Accounts
in pension matters and in connection with the payment of pen-
sions. The Auditor of Public Accounts shall pay quarterly at
such dates as he may prescribe the pensions authorized by
this act.
It is further provided that out of this appropriation of one
million dollars there shall be expended for relief of needy Con-
federate women of Virginia, who are not upon the State pension
roster, and who are not inmates of any Confederate, indepen-
dent or church home or charitable institution, in accordance
with the provisions of the act approved March 10, 1914 (Acts
of Assembly, 1914, chapter 56, page 81)......0.000.0000... $ 11,000 00

the arrest and prosecution of persons charged with the viola-
tion of State laws, including expenses of juries, witnesses,

lic Accounts by reason of ouster proceedings declared void
by the Supreme Court of Virginia; the transportation costs
of the State Board of Public Welfare, as provided by section
1907 of the Code of Virginia (1919), and the. transportation
costs of the Virginia Manual Labor School for Colored Boys
(Acts of Assembly, 1920, chapter 344, pages 515-516), as pro-
vided by the act approved February 5, 1900 (Acts of Assembly,
1899-1900, chapter 273, section 6, page 302), cost of main-
tenance in local jails of persons charged with violation of
State laws, including food, clothing, medicine, medical atten-
tion, guarding, etc., provided, however, that all jail physicians
be paid at the rate provided by law, but not more than five
hundred dollars per calendar year shall be paid the jail phy-
sician or physicians for any city or county; and coroner’s fees,
cte, said compensation for jail physician to be paid at the end
of the calendar year, provided, however, that in case of death or
resignation, his compensation shall be prorated on the basis the
time of service bears to the full calendar year.
It is provided, however, that no part of this appropriation
shall be used for the payment of criminal charges incident
to prisoners employed on the State convict road force or the
transportation costs of prisoners committed to the custody of
the Virginia Industrial School for Boys (Acts of Assembly,
1920, chapter 76, pages 64-66).

It is hereby provided that all fees and licenses collected
by the Motor Vehicle Commissioner for licensing motor vehicles
and for issuing and registering certificates of title thereto and
all taxes collected by the Motor Vehicle Commissioner on motor
vehicle fuels, including in addition to all other fees, licenses,
and taxes all monies received by the Motor Vehicle Commis-
sioner under the provisions of the act, which became a law
July 1, 1924 (Acts of Assembly, 1924, chapter 368, pages 523-
532), relating to the protection of titles to motor vehicles and
to the purchase, sale and storage thereof, after the close of
business February 28, 1926, together with any funds previously
collected for these purposes and still unexpended in the hands
of the Motor Vehicle Commissioner as of said date, shall be
paid directly and promptly into the State treasury to the credit
of the State highway maintenance and construction fund, with-
out deductions of any kind being made therefrom; and it is
provided, further, that all funds held within the State treasury
to the credit of the automobile theft fund at the close of busi-
ness on February 28, 1926, shall be promptly transferred to
the credit of the said State highway maintenance and con-
struction fund, and the said automobile theft fund is hereby
abolished; and it is further provided that the funds herein
appropriated for licensing and registering motor vehicles and
recording titles thereto and for collecting the taxes on motor
vehicle fuels and for carrying out the other duties imposed by
law upon the Motor Vehicle Commissioner shall be paid out
of the State highway maintenance and construction fund by
warrants drawn on the Auditor of Public Accounts by the
Motar Vehicle Commissioner.
Provided, however, that nothing in this act shall interfere
with the distribution of the revenue from the one-cent tax per
gallon on motor vehicle fuels to the several counties of the
State, in accordance with the provisions of the act approved
March 26, 1923 (Acts of Assembly, 1923, extra session, chapter
107, pages 128-129).

an amount not exceeding five thousand dollars for training and
caring for blind children under eight years of age, or who are
not eligible to enter the State schools for the blind, said sum
of five thousand dollars to be used and expended under direc-
tion and supervision of the Virginia Commission for the Blind.
Any unused balance of this sum shall revert to and become a
part of the elementary fund.
It is provided that the entire monies in this whole appro-
priation of one million four hundred and fourteen thousand
eight hundred dollars, except as otherwise provided, shall be
apportioned by the State Board of Education as prescribed by
the Constitution of Virginia to the public free schools of the
several counties and cities of the Commonwealth; provided,
further, however, that ‘tthe said State Board of Education shall
not apportion any of the said fund to any county or city unless
said county or city pay out of local funds at least twenty per
centum of the teachers’ salaries in the said county or city; and
provided further, however, that in exceptional cases the State
Board of Education may except from this rule a county which
is unable to pay more than ten per centum of the teachers’
salaries.

Out of this appropriation shall be paid to each pensioner
in the several classes now on the pension roster, or hereafter
placed on the pension roster, who is entitled, under the act to
appropriate public revenue, approved March 8, 1924 (Acts of
Assembly, 1924, chapter 122, pages 148-241), to $260.00 a year
for total blindness, $270 a year; to $140.00 a year for total
disability, $150.00 a year; to $110.00 a year for partial dis-
ability, $120.00 a year; and to each widow of a soldier, sailor
or marine, who was married prior to December 31, 1882, and
who is otherwise entitled under this act to $80.00 a year,
$90.00 a year, and to the personal representative of each de-
ceased pensioner $25.00 for the funeral expenses of such de-
ceased pensioner ; provided, however, that the said sum of $25.00
may be paid without the qualification of a personal representa-
tive to the undertaker, when such undertaker shall file his bill,
verified by proper affidavit with the Auditor of Public Ac-
counts, together with a copy of death certificate of such pen-
sioner; and the other allowances as authorized by the act
aforesaid; provided further that under the provisions of this
act any person who actually accompanied a soldier in the
service and remained faithful and loyal as the body servant
of such soldier or who served as cook, hostler or teamster or
who worked on breastworks under any command of the army
and thereby rendered service to the Confederacy shall be
entitled to receive an annual pension of twenty-five dollars,
proof of service to be prescribed by Auditor of Public Ac-
counts.
“It is provided, however, that if any assessment hereafter
made of the real estate or personal property or both, owned at
this time by a pensioner on the pension roster shows an in-
creased valuation beyond the amount fixed by law to entitle a
pensioner to draw a pension, such increase shall not operate to
prevent any such pensioner from receiving the pension he shall
receive under the provisions of the said act approved March
8, 1924, provided further that if the property held, as herein-
before provided, by a Confederate soldier, his wife or widow,
assessed at $2,000 or more, yield a total income less than $300,
including income from all sources, such applicant shall not
be denied the benefit of the pension under this section.
It is further provided that the Auditor of Public Accounts
shall not use any part of this appropriation for clerk hire,
expenses, etc.
And it is further provided that out of the appropriation
for public printing, the Superintendent of Public Printing
shall supply all forms and have done and pay for all printing.

It is hereby provided that all fees and licenses collected
by the Motor Vehicle Commissioner for licensing motor
vehicles and for issuing and registering certificates of title
thereto and all taxes collected by the Motor Vehicle Commis-
sioner on motor vehicle fuels, including in addition to all other
fees, licenses, and taxes all monies received by the Motor
Vehicle Commissioner under the provisions of the act which
became a law July 1; 1924 (Acts of Assembly, 1924, chapter
368, pages 523-532), relating to the protection of titles to motor
vehicles and to the purchase, sale, and storage thereof, after
the close of business February 28, 1926, together with any funds

It is provided that this appropriation of five hundred dol-
lars shall be inclusive of all funds received by the Virginia
State Dairymen’s Association from the Commonwealth of Vir-
ginia, and in lieu of any and all contributions from the re-
spective State departments, institutions or other State agencies.

premiums, which is to be applied towards the payment of said
premiums upon the agricultural, horticultural, livestock and
poultry exhibits to be offered, in the name of the Com-
monwealth of Virginia at the annual exhibitions of said as-

It is provided that the Governor of Virginia, and four
others, to be appointed by him, two from the State Board of
Agriculture and Immigration, and two from the board of di-
rectors of the Virginia State Fair Association, Inc., and shall
constitute a committee of five to determine the number, amount
and character of premiums provided for in this appropriation of
five thousand dollars. The said committee shall receive no com-
pensation for their services.
It is provided further that the appropriation of five thou-
sand dollars hereby made shall be subject to payment to the
Virginia State Fair Association, Inc., upon order of the com-
mittee, herewith provided for, by warrant of its chairman.

2. The appropriations provided for in this act for making loans
to students at the several State institutions shall be expended, upon
such terms, and according to such rules, as may be prescribed by the
respective governing boards of the institutions for which the appro-
priations are made, in making loans to needy and deserving students
of talent and character from Virginia in said institutions for the pur-
pose of aiding these to obtain an education at such institutions, who
might not be able otherwise to do so. Such loans shall not exceed
$200.00 in any one session to the same student; and they shall be made
to said students upon such terms, as to time and security, as the au-
thorities of the respective institutions shall determine in each. case;
provided, however, that the rate of interest charged said students on
such loans shall not be less than four per centum per annum...
The said State students’ loan funds shall be preserved from deple-
tion by the said institutions; and, together with the repayments and
accretions thereto, shall be held and used for the purpose specified in
this act and no other; and each of the said institutions shall annually,
not later than July in each year thereafter, file in the office of the
Superintendent of Public Instruction a statement, in detail, showing
for the year past the amounts received by said funds, or the loans
made, to whom made, and upon what terms, the amaunt of the corpus
of said fund, the amounts repaid to said funds, and from whom, and
any other information deemed pertinent by the institution so reporting,
or which may have been requested by the Superintendent of Public
Instruction. |
The Auditor of Public Accounts shall make no payment to any of
the said institutions on account of the said students’ loan funds unless
and until the institution applying for such payment shall have fur-
nished the said Auditor of Public Accounts a certificate from the Su-
perintendent of Public Instruction that such institution has complied
in all respects with the foregoing requirements of this act in relation
thereto.
The State Accountant shall annually audit and exhibit in his annual
report the account of the said funds at each of the said institutions.
3. . All public revenue received into the State treasury within the
two appropriation years provided for in this act, with the exception
of the revenues segregated by law to special purposes, and the balance
of the appropriations made by previous acts of the General Assembly
unexpended at the close of business on the twenty-eighth day of Febru-
ary, nineteen hundred and twenty-six, which unexpended balances are
hereby declared to be lapsed into the ‘State treasury, are hereby desig-
nated the general fund of the State treasury of the Commonwealth of
Virginia, and shall be used for the payment of the appropriations pro-
vided for in this act, subject to the limitations and upon the conditions
set out in this act.
4. The appropriations for the maintenance and operation of public
institutions and the hospitals for the insane shall be paid in monthly
installments, but the Auditor of Public Accounts is hereby authorized
and required to pay the special or extraordinary items provided for in
the appropriations other than for “support” to the institutions and
hospitals for the insane in monthly installments, or otherwise, as, in
his judgment, the condition of the State treasury will permit.
5. No State department, institution or other agency receiving ap-
propriations under the provisions of this act shall exceed the amount
of its appropriations, except in an emergency, and then only with the
consent and approval of the Governor in writing, first obtained; and
if any such State department, institution or other agency shall exceed
the amount of its appropriation with such consent and approval of the
Governor, there shall be no reimbursement of said excess, nor shall
there be any liability or obligation upon the State to make any ap-
propriation hereafter to meet such deficit, and the members of any
governing board of any State department, institution or other agency,
or, if there be no governing board, the head of any State department,
institution or other agency, making any such excessive expenditures—
in the case of members of governing boards, who shall have voted
therefor—shall be personally liable for the full amount of such un-
authorized deficit, and, in the discretion of the Governor, shall be
deemed guilty of neglect of official duty, and be subject to removal
therefor.
It shall not be lawful for the Auditor of Public Accounts to pay
any State department, institution or other agency, including the State
hospitals for the insane and the State Colony for Epileptics and the
Feeble-Minded at Colony, any money except as is provided for in this
act, or in pursuance of some act of the General Assembly making
special appropriation therefor.
6. The proper officer of each State department. institution or
other agency, for which appropriations are made, shall in his annual
report, give an itemized account of the expenditures out of such
appropriations for such State department, institution or other agency.
classified and itemized in accordance with the budget classifications
adopted by the Governor; and every such officer of this State for
whose department, institution or agency appropriations are hereby
made, shall make annually a report of all other sums received by such
department, institution, officer. or other agency from any source, and
such reports and accounts shall embrace the expenditure of all funds
appropriated, including the interest on bonds held by such State de-
partments, institutions, officers, or other agencies, and hereinbefore
directed to be paid to them; which reports shall be forwarded to the
(seneral Assembly and laid before both houses at each session thereof.
7. None of the monies mentioned in this act shall be expended
for any other purposes than those for which they are specifically ap-
propriated, and it shall be the duty of the Governor, as chief budget
ofhcer of the State, or his deputy, to see that this provision is strictly
observed ; and, should he find that the said monies are not being ex-
pended in accordance with the provisions of this act, or that the ex-
penditures under any appropriation included in this act are in excess
of the amount necessary to carry out the purpose for which said ap-
propriation was made, he is hereby given the power to restrain the
Auditor of Public Accounts from making further disbursements, in
whole or in part, out of said appropriations, to the offending State
department, institution, officer or other agency receiving appropriations
under the provisions of this act; provided, however, that the several
appropriations made by this act out of the general fund of the State
treasury may not only be used for the purposes specified in this act,
but authority is hereby given to the governing board of any State de-
partment, institution or other agency, or, if there be no governing
board, to the head of such department, institution or other agency
named in this act, to transfer, within the respective department, institu-
tion or other agency, any such appropriations from the object for
which specifically appropriated or set aside to some other object
deemed more necessary in view of later developments, subject, how-
ever, in every case, to the consent and approval of the Governor, in
writing, first obtained ; and provided that the total amount appropriated
to the respective department, institution or other agency shall in no
case be exceeded; and, further provided, that such appropriations be
withheld by the Governor from any State department, institution,
officer, or other agency, named in this act, as herein provided, or should
transfers be authorized by the Governor, as herein provided, he shall
set forth fully, in each case, the reasons for withholding said ap-
propriations or for authorizing the transfer of said appropriations, as
the case may be, in the next budget submitted to the General As-
sembly in accordance with law.
8. Should legislation be enacted at the session of the General
Assembly which convened January: 13, 1926, diverting or withdrawing
from any agency or agencies of the State government of Virginia for
all or any part of the biennial appropriation period ending February
29, 1928, revenues from property taxes now segregated to such agency
or agencies, for the maintenance of public free schools, or for the con-
struction of State highways or for the eradication and prevention of
tuberculosis, an equal amount is hereby appropriated out of the general
fund of the State treasury to be expended for said purposes by said
agency or agencies in lieu of the segregated revenues from property
taxes diverted or withdrawn therefrom; provided, however, that the
increased appropriation out of the general fund of the State treasury
hereby conditionally authorized for the construction of State highways
shall not exceed the amount obtained by deducting from the segregated
revenues from property taxes diverted or withdrawn from the con-
struction of State highways the additional revenue, if any, obtained
during the biennium ending February 29, 1928, by the equalization
of automobile licenses on the basis of seventy cents per one hundred
pounds of weight or fraction thereof instead of on the basis of horse-
power, and the amount of additional revenue so obtained shall be
determined by the Governor of Virginia by comparing the total revenue
collected from the issuance of automobile licenses on a weight basis
during such part of said biennial appropriation period as licenses are
issued on said basis with the amount of revenue the issuance of said
licenses during the same period on a horsepower basis, would have
yielded. In determining, under this section, the amount of any segre-
gated revenues from property taxes diverted or withdrawn from the
objects aforesaid the calculation shall be made by the Governor of
Virginia on the basis of the rate of return from the said revenues
shown by table 2, page 19, of the Virginia State Budget for the 1926-28
biennium.
9. No appropriation made by this act to any institution, board,
commission, or agency not owned or controlled by the State of Vir-
ginia shall be expended except with the consent and approval of the
head or governing board of the State department herein designated to
supervise said expenditures. The warrants or checks drawn upon the
Auditor of Public Accounts for said expenditures shall be itemized
and classified in accordance with the budget classifications adopted by
the Governor, and shall be countersigned by the head or executive
officer of said State department designated for such purpose. It shall
be the duty of each of said institutions, boards, commissions, and
agencies to submit its biennial budget estimates to the head or execu-
tive officer of said State department for examination, whose approval
endorsed thereon shall be a prerequisite to consideration of said bien-
nial budget estimates by the Governor. The accounts of each of the
said institutions, boards, commissions, and agencies, shall be subject
to audit by the State Accountant at the direction of the Governor.
It shall be the duty of the Auditor of Public Accounts to exercise,
as herein required, control and supervision over the expenditures and
budget estimates of the Confederate Memorial Associations.
It shall be the duty of the State Librarian to exercise, as herein
required, subject to the approval of the Library Board, control and
supervision over the expenditures and budget estimates of the Con-
federate Museum at Richmond.
It shall be the duty of the Superintendent of Public Instruction
to exercise, as herein required, subject to the approval of the State
Board of Education, control and supervision over the expenditures
and budget estimates of the Co-operative Education Association and
the Parent-Teacher Association.
It shall be the duty of the Commissioner of Agriculture and Im-
migration to exercise, as herein required, subject to the approval of the
State Board of Agriculture and Immigration, control and supervision
over the expenditures and budget estimates of the Virginia Crop
Improvement Association, the Virginia State Dairymen’s Association,
the Virginia State Fair Association, and the Virginia State Horticul-
tural Society.
It shall be the duty of the Commissioner of Public Welfare to
exercise, as herein required, subject to the approval of the State Board
of Public Welfare, control and supervision over the expenditures and
budget estimates of the Home for Needy Confederate Women, the sev-
eral Travelers’ Aid Societies receiving appropriations from the State
of Virginia, and the Virginia Home for Incurables.
10. All the appropriations herein made for the two years ending
respectively on February 28, 1927, and on February 29, 1928, un-
expended at the close of business on February 29, 1928, shall revert
to and become a part of the general fund of the State treasury of the
Commonwealth of Virginia, and shall not thereafter be paid by the
Auditor of Public Accounts; and the same shall be charged off upon
the books of his office.
11. All acts and parts of acts inconsistent with the provisions of
this act be and the same are hereby repealed.
12. This act shall be in force from its passage.
