Chap. 76.—An ACT to validate the issuance of $14,500 of road and street improve~
ment bonds of the town of Clarksville, Virginia. [S B 173}

Whereas, by an act approved March twenty-fourth, nineteen
hundred and twenty, the mayor and council of the town of Clarksville,
in the county of Mecklenburg, were authorized and empowered to is-
sue and sell bonds of the said town in an amount not to exceed fourteen
thousand, five hundred dollars, for the purpose of constructing, improv-
ing and maintaining the roads and streets thereof, and
Whereas, the said act provided that the said bonds should not be
issued and sold until the question had been submitted to and approved
by the qualified voters of the said town of a special election to be called
for the purpose by a proper ordinance within two years, and
Whereas, a special election to pass upon the proposed bond issue
was called on October tenth, nineteen hundred and twenty-one, by the
council of the said town, to be held on the twenty-second day of Novem-
ber, nineteen hundred and twenty-one, and at the said election a ma-
jority of the qualified voters of the town voting at such election voted
in favor of the proposed bond issue, and
Whereas, it now appears that such election was called by the council
of the town of Clarksville by a resolution instead of by a proper ordi-
nance as described in the said act, and the power of the mayor and
council to issue the said bonds has been questioned, and
Whereas, it is desirable that there shall be no doubt as to the validity
of the said bond issue; now, therefore, ,
1. Beit enacted by the general assembly of Virginia, That all pro-
ceedings heretofore taken by the council of the town of Clarksville in
calling a special election to pass upon the question of whether or not
the mayor and council of the said town should issue fourteen thousand,
five hundred dollars in bonds for the purpose of constructing, improving
and maintaining the roads and streets of the said town, and all acts
done and proceedings had in connection with the issuance of such bonds,
are hereby validated, ratified, approved and confirmed, and such bonds
are hereby made and declared to be valid and binding obligations of the
said town of Clarksville, notwithstanding any defect or irregularity in
the calling or holding of the said election, or in the proceedings of the
council of said town authorizing the issuance and sale of said bonds.
2. An emergency existing, this act shall be in force from its passage.
