a fraud upon the public; and prohibiting the manufacture, sale or exchange of

1. Be it enacted by the general assembly of Virginia, That filled
milk, as herein defined, is hereby declared to be an adulterated article
of food, injurious to the public health, and that its sale constitutes a
fraud upon the public. :
2. The term “filled milk’ means any milk, cream or skimmed milk,
whether or not condensed, evaporated, concentrated, powdered, dried,
or desiccated, to which has been added, or which has been blended or
compounded with, any fat or oil other than milk fat.
3. It shall be unlawful for any person, firm, corporation or asso-
ciation to manufacture, sell or exchange, or have in possession with
intent to sell or exchange, any filled milk under any name whatsoever.
4. Nothing in this act contained shall be construed as prohibiting
the use of chocolate as a flavor; nor shall this act be construed as in-
tended to apply to any article while the same is under the protection of
the interstate and foreign commerce clause of the Constitution of the
United States.
5. The dairy and food commissioner and his assistants are hereby
charged with the enforcement. of this act.
6. Any person, or any member or agent of any firm or association,
or any Officer, director or agent of any corporation, violating any pro-
vision of this act, shall be guilty of a misdemeanor, and, upon convic-
tion, be fined not exceeding five hundred dollars, or imprisoned in jail
for not exceeding six months or botb.
