1. Be it enacted by the general assembly of Virginia, That section
four thousand seven hundred and eighty-one, of the Code of Virginia,
be amended and re-enacted so as to read as follows:
- Section 4781. When statement by accused as witness not received
as evidence; justices as witnesses.—In a criminal prosecution, other than
for perjury, or in an action on a penal statute, evidence shall not be
given against the accused of any statement made by him as a witness
upon a legal examination, unless such statement was made when ex-
amined as a witness in his own behalf. No justice of the peace, police
justice, civil and police justice, juvenile and domestic relations court
judge or other trial justice shall be competent to testify against the ac-
cused in a court of record as to statements made by the accused on his
trial by such justice or on his preliminary examination before such jus-
tice.
