Chap. 350.—An ACT to create boards of finance in and for the counties of Taze-
well, Dickenson and Wise, State of Virginia, and to prescribe their powers
and duties. [H B 238]
Approved March 20, 1924.
1. Beit enacted by the general assembly of Virginia, That there be
and is hereby created a board of finance in and for each of the counties
of Tazewell, Dickenson and Wise, the membership of which shall be as
follows: The chairman of the board of supervisors, who shall be ex-
officio chairman of the said board of finance; the chairman of the county
school board, and the county treasurer, any two of whom may consti-
tute a quorum for the transaction of business.
_ 2. Said board of finance shall organize not later than the first of
August next following the passage of this act, and shall select one of its
members secretary. The members of said board shall serve without
pay, but may expend an amount not exceeding one hundred dollars per
annum for necessary expenses, payable, one-half out of the county levy
and one-half out of the county school fund. They shall hold office
during the period for which they have respectively qualified as chairman
of the board of supervisors, chairman of the county school board, and
county treasurer. Vacancies on said board shall be filled by appoint-
ment or election of any of the officers herein mentioned.
3. Whenever the funds under the control of the board of super-
visors or the county school board shall become so depleted as to prevent
the prompt payment of current expenses for the regular and necessary
operation of the various activities under the management of either of
the above mentioned boards, such board may appeal to the board of
finance, in writing, requesting an advance of funds, out of any money in
the treasury for which there will be no need during the period of time
stipulated in such request, and setting forth its needs in full and ex-
plicit terms, accompanied by a written statement from the county treas-
urer showing the condition of the treasury, and if the condition of the
treasury permit, the said board of finance shall authorize an advance of
funds as requested, or for so much thereof as in its judgment it seems
proper to allow, and shall direct the county treasurer to make the neces-
sary transfer upon the books of his office; provided, however, that in
no event shall said advance of funds exceed fifty per centum of the bal-
ance on hand to the credit of the fund or funds out of which said advance
is made or the estimated annual income of the department of govern-
ment making the request, nor shall said advance be for a longer period
than six calendar months, and provided, further, that the county treas-
urer shall credit the fund or funds out of which the advance is made,
with the first money coming into his hands belonging to the fund to
which the advance is made, plus the interest which would have accrued
to said fund or funds, had no advance been made.
4. All acts and parts of acts in conflict with this act are hereby
repealed.
