Chap. 258.—An ACT to provide how the incorporation of towns in Fauquier county
heretofore incorporated by a court may be annulled. (S B 379]
Approved March 14, 1924.
1. Be it enacted by the general assembly of Virginia, That upon
application, in writing, of five (5), or more, of the qualified voters of any
town in the county of Fauquier, heretofore incorporated by the court,
presented to the circuit court of Fauquier county, and upon it being
made to appear to the satisfaction of said court, or the judge thereof
in vacation, that there has been no election of a mayor, or of councilmen,
for said town, at the preceding regular election; or, that notwithstand-
ing such election, the said mayor, or councilmen, have failed to qualify;
or to perform their official duties; or that said council have failed for a
period of two years to levy or to collect the town taxes; or whenever it
shall appear that the corporation has ceased to function as a town, the
court or the judge thereof in vacation, may enter an order annulling and
repealing an order incorporating such town, and thereafter all the rights
and powers of said town shall cease.
2. Notice by publication for two weeks in some newspaper pub-
lished in Fauquier county of said petition shall be made before an appli-
cation to the court, and the board of supervisors of Fauquier county
shall be made parties defendant to said petition.
3. The provisions of this act shall not be exclusive of the remedies
provided for by an act of the general assembly, approved March four-
teenth, nineteen hundred and twenty-two.
4. Upon the entry, by the court, or the judge thereof in vacation, of
an order annulling the charter of any town in Fauquier county, no delin-
quent taxes shall be, or remain, a lien upon any property in said town.
5. An emergency is hereby declared to exist, and this act shall be
in force from its passage.
