Chap. 240.—An ACT to incorporate and provide a charter for the town of Port
Richmond, in the county of King William. [H B 369)
Approved March 14, 1924.
1. Be it enacted by the general assembly of Virginia, That the
inhabitants of the territory in King William county contained within
the boundaries prescribed in section two hereof be, and they are hereby
declared to be, a body politic and corporate in fact and in name, under
the name and style of the town of Port Richmond; and as such shall
have and exercise all the powers conferred by, and be subject to all the
laws of the State of Virginia now in force, or that may hereafter be en-
acted, for the government of towns of less than five thousand inhabi-
tants, so far as the same are not inconsistent with the provisions of this
act.
2. The boundaries of the town shall be as follows: Beginning at
the Pamunkey river at its intersection with the northerly line of the town
of West Point; thence running easterly along the said northerly line of
the town of West Point, across the Southern railway right of way to
the easterly line of the State highway leading from West Point to King
William courthouse, thence running northerly along the easterly line of
said State highway to the southerly line of twenty-ninth street, as shown
on the plat of Port Richmond subdivision recorded in deed book twenty-
seven, page eighty-nine, in the records of the clerk of the circuit court of
King William county; thence easterly along the southerly line of said
twenty-ninth street across QO. D. I. street to the northeasterly corner of
lot one hundred and nine in said subdivision; thence northerly crossing
said twenty-ninth street and extending along the northerly line of lots
one hundred and ten to one hundred and nineteen, inclusive, to: the
southwesterly corner of lot number twenty-four in said subdivision;
thence easterly along the southerly line of lots twenty-four and twenty-
five across Mattaponi avenue and along the southerly line of lots twenty-
six, twenty-seven and one hundred and fifty-four across Chelsea road
and along the southerly line of lot one hundred and ninety-five and this
line projected across the marsh to the Mattaponi river; thence meander-
ing in a northerly direction along the said Mattaponi river to the point
of contact with the northerly line of lot number two hundred and two
as projected to said river; thence south forty-nine degrees west along
said projected northerly line of lot number two hundred and two and
along said northerly line of said lot number two hundred and two and
across Chelsea road and along the northerly line of lot number one hun-
dred and forty-seven to the easterly line of lot number eighty-five;
thence southerly along said easterly line of said lot number eighty-five
about seventy-five feet to the southeasterly corner of said lot number
eighty-five; thence south forty-nine degrees west along the southerly
line of said lot number eighty-five across Mattaponi avenue and along
the southerly line of lots number seventy-eight and seventy-seven, across
O. D. I. street, continuing along the southerly line of lot number sixty-
eight and on the course of south forty-nine degrees west across the afore-
mentioned State highway, across the Southern railway right of way and
across Euclid boulevard to the Pamunkey river; thence meandering
easterly and southerly along the Pamunkey river to the point of begin-
ning.
3. The legislative, executive, and administrative powers of the town
shall be exercised by a council consisting of three members who shall be
elected for a term of six years; provided that at the first election, which
shall be held on the second Tuesday in June in the year nineteen hundred
and twenty-four, which said election shall be held in accordance with
the general election laws of the State of Virginia, the qualified voters
of the town shall elect one councilman for a term of two years, one for
a term of four years, and one for a term of six years, which terms shall
begin on the first day of September following. At an election, which
shall be held on the second Tuesday in June, in the year nineteen hundred
and twenty-six and biennially thereafter, on the second day of June,
which said elections shall be held in accordance with the general election
laws of the State of Virginia, one councilman shall be elected to serve
for a period of six years from the first day of September following, and
until his successor has been elected and duly qualified. The councilmen
so elected shall serve without pay. With the exception of those officers
whose election by popular vote is required by the Constitution of Vir-
ginia, the members of the council shall be the only elective officers of
the town. The council shall elect one of its members who shall be des-
ignated as mayor to preside over the meetings of the council. He shall
have no veto power. The council shall be elected at large from the
qualified voters of the town.
4. Crosby Thompson, J. T. Dansey and J. A. Tokarz shall compose
the first council of the town of Port Richmond, from the time this act
shall take effect, until the first: day of September, in the year nineteen
hundred and twenty-four and until their successors have been elected
and duly qualified. All councilmen of the said town shall serve without
pay. None but qualified voters living within the town limits shall be
eligible to serve as councilmen.
5. The council shall, from time to time, designate and assign the
particular administrative duties of each of its members, and each mem-
ber of the council shall be designated for particular service as the head
of a department, or departments, over which he shall have special over-
sight and direction, subject to the provisions of the Constitution and the
laws of the State of Virginia and the ordinances of the council. Such
designations and assignments may be changed whenever desired by the
council and during any temporary disability or absence of a couneilman,
the council may designate another member to act until the disabled or
absent councilman shall resume his duties.
6. The council shall, at its first meeting, or as soon thereafter as
practicable, determine what appointive officers are necessary for the
proper and efficient administration of the town and shall prescribe the
qualifications, powers and duties of such officers, and fix their compensa-
tion. The council shall forthwith, or as soon as desirable, make ap-
pointments to fill such offices. All other employees of the town shall
be employed by the council or under its authority. Any officer, or
employees, whether appointed by the council or under its authority,
may be removed by the council at any time, except as especially pro-
vided by law; the councilman designated as head of a department shall
have power of removal of any officer or employee in such department.
_ 7. The mayor shall attend the meetings of the council and preside
thereat; he shall have the same power as a councilman, to vote on all
matters coming before the council, but shall have no veto power. It
shall be the duty of the mayor to acquaint himself with the conduct of
each of the departments (in addition to those under his immediate su-
pervision) and from time to time report to the council thereon, with such
recommendations as he shall deem desirable.
8. The said council shall have power to pass all by-laws and ordi-
nances for the proper government of the town and not in conflict with
the Constitution and laws of the State of Virginia or the Constitution
and laws of the United States. The council shall have authority to pass
ordinances to regulate the use of the streets of the town, to maintain
order and to enforce the laws and ordinances of the town. The council
of the town of Port Richmond shall have all the powers conferred and
the duties imposed on councils of towns of less than five thousand in-
habitants by the Constitution and laws of the State of Virginia.
9. The property in the town of Port Richmond shall not be liable
to the county for any road tax and the territory of the said town shall
not be embraced within any road district of the county of King William.
10. An emergency existing by reason of local conditions, this act
shall be in force from its passage.
