Chap. 199.—An ACT to amend and re-enact section 5889 of the Code of Virginia
as amended and re-enacted by an act which became a law on the 8th day of
March, 1920. (S B 242]

1. Be it enacted by the general assembly of Virginia, That section
fifty-eight hundred and eighty-nine of the Code of Virginia, as amended
and re-enacted on the eighth day of March, nineteen hundred and
twenty, be, and the same hereby is amended and re-enacted so asto
read as follows:
Section 5889. Vacancies in the office of judge; new circuits; how
judges elected; duration and commencement of terms of office.—When-
ever a vacancy occurs in the office of judge his successor shall be elected
for the unexpired term, and upon qualification, shall enter at once upon
the discharge of the duties of his office. Provided however the governor
shall have the power during the recess of the general assembly to fill
pro tempore vacancies In such office, but his appointment to such vacan-
cies shall be by commission to expire at the end of thirty days after the
commencement of the next session of the general assembly.
If a new or additional circuit be created, a judge shall be chosen
therefor by the joint vote of the two houses of the general assembly for
a term of eight years, commencing on the first day of February next
following his election, and the governor may either appoint a judge for
such circuit for the time elapsing from the date of its creation until the
commencement of such term, or designate one or more circuit judges
or judges of city courts of cities of the first class to act as judge of
the several counties and cities composing such new circuit for the time
aforesaid.
2. An emergency is hereby declared to exist, and, accordingly this
act. shall be in force and effect from and after its passage.
