Chap. 141.—An ACT to amend and re-enact section 3196 of the Code of Virginia
in relation to penalty and evidence in prosecutions for unlawful fishing.

1. Be it enacted by the general assembly of Virginia, That section
thirty-one hundred and ninety-six of the Code of Virginia, be amended
and re-enacted so as to read as follows:
Section 3196. Penalty for violating the preceding section; possession
of the fish evidence of guilt.—Any person violating any of the provisions
of the preceding section shall, on conviction thereof, be fined for each
offense not less than five nor more than two hundred and fifty dollars
and be imprisoned in jail until the fine is paid, but not exceeding thirty
days, and forfeit all boats, nets, or other contrivance employed by him
in such violation. In a prosecution of a person for a violation of any
subdivisions of said section the possession by such person of any of the
fish mentioned in said subdivision shall be prima facie evidence of his
guilt.
