Chap. 124.—An ACT to authorize, empower and require the board of supervisors
of Grayson county to borrow the sum of $23,000.00 and to issue bonds therefor
for the repair, improvement and construction of certain roads and bridges in
Wilson, Providence and Old Town magisterial districts of said county; to pro-
vide for the expenditure of the funds raised by such bond issues; to authorise
the employment of civil engineers or men versed in road building, road builders
and labor; to specify the roads and parts thereof to be constructed and the
amounts to be expended thereon; to provide for imposing a tax on all property
county and district, including property in any incorporated town situated
within the above named districts, for the purpose of paying the interest and
principal of such debt; to do all things necessary, needful or incidental to the
main purpose of this act; and to declare an emergency. [S B 398]
Approved March 8, 1924.
1. Beit enacted by the general assembly of Virginia, That the board
of supervisors of Grayson county be, and it is hereby authorized, empow-
ered and required to issue bonds in the name of the county of Grayson for
the purpose of surveying, repairing, constructing and improving certain
roads and building bridges thereon in Wilson, Providence and Old Town
magisterial districts, as hereinafter set forth, to-wit: the sum of nine
thousand dollars for Wilson magisterial district, the sum of seven thou-
sand dollars for Providence magisterial district and the sum of seven
thousand dollars for Old Town magisterial district in said county of
Grayson.
2. The said board of supervisors are authorized, empowered and
hereby required, after issuing said bonds, when the next levy is made,
or tax imposed in said county, to levy a tax on all property liable to
county and district tax in each magisterial district of the county in which
the proceeds of the bonds have been or are to be expended, including
such property located on the situs of which for taxation is within the
limits of any incorporated town situated within such district, to pay the
interest on said bonds so issued and to create a sinking fund to redeem
the principal of said bonds at maturity.
' 3.4.The said bonds, when issued, shall be delivered to the treasurer
of Grayson county and when said bonds are sold he shall deliver the
bonds to the purchaser or purchasers and these bonds shall be sold and
marketed as now provided by general law for the sale and marketing of
county road bonds. The said bonds when issued, shall be signed by the
chairman of the board of supervisors and countersigned by the clerk of
said board and the seal of the board affixed; these bonds shall be issued
in serial number and shall be payable from one to ten years, one-tenth
of the principal of said bonds shall become due and payable every year
from date of issue. Nine hundred dollars ($900.00) par value of the
bonds issued for Wilson magisterial district and seven hundred dollars
($700.00) par value of the bonds issued for Providence and Old Town
magisterial districts to be paid and retired each year.
4. The said board of supervisors are hereby authorized, empowered
and required to make, issue and sell all of said bonds authorized and
directed to be issued by this act and all of said bonds shall be issued and
sold and all work done and completed on said roads and bridges men-
tioned in this act within two years from the passage of this act, but no
bonds shall be sold for less than par value thereof and shall not bear a
greater interest than six per centum per annum, interest to be paid on
the said bonds semi-annually, bonds to be issued in denominations of
not les; than one hundred dollars and not more than one thousand
dollars. ;
5. All money realized from the sale of said bonds under the pro-
visions of this act shall be received by the treasurer of said county and
he shall keep said money separate from any other money that may come
into his hands as treasurer, and shall keep the money separate in each
magisterial district, and for his services required of him by this act he
shall be paid according to law.
6. The board of supervisors of the county of Grayson shall issue
and make sale as hereinbefore stated of bonds in the sum of nine thou-
sand dollars for the Wilson magisterial district in said county, and the
sum of seven thousand dollars for the Providence magisterial district in
said county, and the sum of seven thousand dollars for the Old Town
magisterial district in said county, but the full faith and credit of the
entire county of Grayson is to be pledged to the payment of all the said
bonds of each district and the interest on the same. _
7: The board of supervisors of the said county of Grayson, shall, at
their next monthly meeting after the passage of this act, pass a resolu-
tion authorizing the issue of said bonds and the purpose for which said
bonds are to be issued, and when said bonds are issued they are to be
made payable to bearer and shall be negotiable and each bond shall
state when due and payable and shall be made payable at the office of
the treasurer of Grayson county; and said board of supervisors shall
cause to be printed on each bond the name of the magisterial distriet
for which it is issued, but that the full faith and credit of the entire
county of Grayson is pledged to the payment of said bonds and the
interest on the same, and that said bonds are issued in pursuance of a
resolution of the board of supervisors of Grayson county and in pur-
suance of authority, empowering and requiring the board of supervisors
of the county of Grayson to issue said bonds and to market said bonds
as the law requires and in pursuance of this act.
8. Each member of the board of supervisors of said magisterial
districts of said county of Grayson is hereby authorized, empowered and
required to expend within two years from the passage of this act the
money from the sale of the bonds of his magisterial district on the roads
specifically mentioned and described in his district and each supervisor
shall keep an itemized account of all work done and money expended in
the construction, surveying, repairing and improving the roads and
bridges on said roads designated in his magisterial district.
Each supervisor is authorized, required and empowered to appoint
all overseers, foremen and subordinates as he considers necessary to
carry out the provisions of this act and to have the work done on said
roads and bridges on the same herein mentioned and specified and shall
pay to them not more than twenty-five cents per hour, and each super-
visor of said magisterial districts shall employ a civil engineer or some
man well versed in road building to assist him in having the work per-
formed on the roads and bridges of said roads specifically mentioned
in this act and shall pay to him not exceeding five dollars ($5.00) per
day, while the work is being done on the roads and bridges mentioned
in this act, and no supervisor shall pay more than twenty-five cents per
hour to each adult laborer for work, and not more than fifty cents per
hour for two-horse team, wagon and driver.
9. Before any work is actually commenced on any road mentioned
and described in this act the supervisor of the district in which the road
is located shall have the road surveyed and located by a civil engineer
or by some person, who is thoroughly competent to survey and locate
public roads, provided said roads have not already been surveyed and
located.
The supervisor of each magisterial district shall have the amount of
money herein designated spent on each road mentioned in this act in a
fair and equitable way and shall distribute the work over the entire
road and shall cause to be hauled and distributed where necessary on
each of said roads, sand, gravel and any other substance that will im-
prove the road and cause the same to be dry and solid; he shall cut out
as many of the steep grades on each road as possible and shall see that
no road herein mentioned exceeds five degrees.
10. Each supervisor shall make out an itemized account of all work
done by him or under his charge or direction, showing the teams, tools,
implements and machinery used and the number and names of the
laborers employed and dates on which the work was done and the num-
ber of hours worked by each laborer and shall then issue a warrant on
the treasurer of Grayson county and give the same to the person perform-
ing the labor and the treasurer of the county shall pay the same out of
the funds arising from the sale of said bonds of the magisterial district
in which the work and labor has been performed.
11. The said board of supervisors shall cause to be kept by the
clerk of the board of supervisors a book, in which an itemized account
of all work done, and all money expended on the roads and bridges
mentioned in this act and published in the manner provided by law for
the publication of other expenditures. The board of supervisors shall
devise a system of bookkeeping in order to carry out the intention of this
act, and require the clerk of said board to keep said books as directed
and also require the treasurer of said county to keep his books in ac-
cordance with rules and regulations laid down by them; the clerk of said
board shall be paid the sum of fifty dollars ($50.00) per year for his
services required of him by this act.
12. The supervisor of the Old Town magisterial district, in con-
junction with the civil engineer, or the man well versed in road build-
ing, whom he shall employ, shall construct, improve and repair the fol-
lowing roads and bridges thereon in his magisterial district, and none
other, out of the funds derived from the sale of the bonds of his magis-
terial district and shall expend on each road herein mentioned of said
funds, the following amount to-wit:
(a) The sum of fifteen hundred dollars on the public road from
Baywood to the North Carolina line via Peach Bottom.
(b) The sum of thirty-five hundred dollars on the public road from
Fries to Galax.
(c) The sum of one thousand dollars on the public road from near
Reavis’ Mill to the North Carolina line via Dalhart and A. J. Todd place.
(d) The sum of one thousand dollars on the public road from Low
Gap to Carroll county line near Thomas Higgins’ via Snow Hill.
14. The supervisor of Providence magisterial district in conjunc-
tion with the civil engineer, or the man well versed in road building,
whom he shall employ, shall construct, improve, and repair the follow-
ing roads and bridges thereon in his magisterial district, and none
other, out of the funds derived from the sale of the bonds of his magis-
terial district mentioned in this act and shall expend on each road
herein mentioned of said funds the following amount, to-wit:
(a) The sum of three thousand dollars on the road from the State
highway at the mouth of Boag’s branch to corporate limits of the town
of Fries via M. C. Porter’s and Rural Home.
(b) The sum of four thousand dollars on the public road leading
from Providence church to the Elk Creek and Providence magisterial
district line near P. H. Cornett’s place, all this sum to be expended on
that portion of the road west of W. H. Boyer’s commencing to improve
the road at a point in said road near W. H. Boyer’s up Knob Fork creek
via J. P. Hale’s and S. L. Bourne’s to the said P. H. Cornett place.
15. The supervisor of the Wilson magisterial district, in conjunc-
tion with the civil engineer, or the man well versed in road building
whom he shall employ, shall construct, improve and repair the follow-
ing roads and bridges thereon in his magisterial district, and none other,
out of the funds derived from the sale of the bonds of his magisterial
district mentioned in this act dnd shall expend on each road herein
mentioned of said funds the following amount, to-wit:
(a) The sum of four thousand dollars on the public road west of
Cicero Osborne’s house to White Top Gap.
(b) The sum of three thousand dollars on the public road com-
mencing in the Blue Spring Gap road at the Wilson and Elk Creek
magisterial district line to the Smyth and Grayson county line via
Roberts’ cove, T. C. Roberts’ residence, W. W. Roberts’ residence,
Wiley Parks’ residence, J. M. Jenkins’ store, Flat Ridge post office and
Z. A. Phipps’ store.
(c) The sum of fifteen hundred dollars on the public road at J. M.
Jenkins’ store to intersect with the public road passing by H. A. Hoff-
mans’ via J. C. Roberts’, D. R. Cornetts’ and Rockbridge church.
(d) The sum of five hundred dollars on the public road known as
the Bear Branch road via D. J. Parsons’ dwelling, commencing in the
public road leading from Grassy Creek to A. H. Wells’ near the Griffin
place, thence down Bear Branch to intersect with the public road known
as the Mouth of Wilson and Troutdale road.
16. Each supervisor shall be allowed the sum of four dollars per
day while he is actually engaged in having the work done in his dis-
trict on the public roads and bridges thereon mentioned in this act and
no supervisor shall be paid for more than thirty days per year under this.
act for services rendered by him.
17. This act shall be construed as mandatory, requiring the board
of supervisors of Grayson county to issue the bonds, to lay a levy on the
property of each magisterial district liable to the county and district
tax to pay for the bonds and the interest on same to have the work per-
formed mentioned in this act and to require the supervisors and each
member thereof to have all the work done on the roads and bridges on
said roads mentioned in this act. .
17-a. The purchasers of the bonds authorized to be issued by this
act shall in no event be required to see to the application of the pur-
chase money.
18. This act shall be construed to the end that its purposes shall
be fully carried out.
19. In view of the fact that the roads mentioned and described and
laid out in each magisterial district in this act are badly in need of re-
pair and improvement, an emergency is declared to exist and this act
shall be in force from its passage.
