improperly paid by him into the treasury of the State of a aw

Whereas, Robert Landreth, of the county of Wythe, became
surety on a certain recognizance for the appearance of John
Suthers, on the first day of Wythe county circuit court to answer
of a certain indictment then pending against him, and
Whereas, the penalty of the said recognizance was _ five
hundred dollars: and
Whereas, the said John Suthers failed to appear on the said
first day of the July, nineteen hundred and twenty-one term
of the circuit court of Wythe county; and
Whereas, the said Robert Landreth afterwards succeeded
in apprehending the said John Suthers and bringing him before
the circuit court of Wythe county, in which said court he was
tried and convicted; and
Whereas, the said Robert Landreth has paid unto the Com-
monwealth of Virginia the said sum of five hundred dollars,
together with costs on account of becoming surety for the ap-
pearance for the said John Suthers; now, therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby directed to
draw his warrant in favor of Robert Landreth for the sum
of five hundred dollars, payable out of any money in the
treasury not otherwise appropriated. in full payment of the
above claim.
