Chap. 40.—An ACT to amend and re-enact an act entitled an act for
the protection of fish in Washington county, approved March 8,
1894, as heretofore amended. [fH B 58]

1. Be it enacted by the general assembly of Virginia, That
an act entitled an act for the protection of fish in Washington
county, approved March eighth, eighteen hundred and ninety-
four, as heretofore amended, be further amended and _ re-
enacted so as to read as follows:
See. 1. It shall be unlawful for any person to catch or
take fish of any kind or description from any stream in Wash-
ington county by any method or means other than angling
with hook and line, trot line, gun or gigs, except as herein-
after provided.
Any person violating any of the provisions of this section
shall, upon conviction, be fined not less than ten nor more than
fifty dollars.
Sec. 2. It shall be unlawful to use fish berries, lime,
giant powder, dynamite or other explosive or chemical sub-
stance of any kind for the purpose of taking or catching of
fish, in any creek, pond or river of Washington county, at any
time.
Any person violating the provisions of this section shall
upon conviction, be fined not less than fifty nor more than two
hundred dollars, or be confined in jail for a period of not less
than thirty nor more than ninety days, or both.
Sec. 3. It shall be unlawful for any person to catch or
take any fish in any of the waters of Washington county by
means of seines or dip nets of any kind, except minnow seines
not over four feet in length, between the first day of April and
the first day of July, and it shall be unlawful to fish with
seines or dip nets of any kind at any time exceeding twenty-
five feet in length.
Any person violating any of the provisions of this section
shall, upon conviction, be fined not less than fifty nor more than
one hundred dollars, or imprisoned in jail for a term of not
less than ten nor more than thirty days, or both, in the discre-
tion of the court or magistrate trying the same.
Sec, 4. It shall be unlawful for any person to take any
species of black bass or Southern chub from any of the waters
of Washington county by any method or means in any way
than with hook and line. It shall be unlawful to catch the
above-mentioned fish in the waters of Washington county by
means of hook and line, except from the fifteenth day of June
of each year to the first day of April of the following year.
Any person violating any provision of this section shall,
upon conviction, be fined not less than fifty nor more than one
hundred dollars, or imprisoned in jail not less than ten nor
more than thirty days, or both. :
Sec. 5. One-half of any fine imposed and collected for the
violation of any section of this act shall be paid to any person
who gives information to any proper officer or instigates a
prosecution for the violation of any of the above sections, in
which there may be a conviction.
Sec. 6. All acts or parts of acts relating to the taking,
catching or destruction of fish, in Washington county, in con-
flict with any of the provisions of this act, are hereby repealed.
But nothing in this act shall be construed as prohibiting the
department of game and inland fisheries in operating in any
manner in a scientific way or for replenishing the streams or
diminishing the carp or other undesirable fish.
2. An emergency existing, this act shall be in force from
its passage.
