CHAP. 38.—An ACT to provide additional funds for the construction,
improvement and maintenance of public roads, highways and bridges
in the magisterial districts of Washington county; and to authorize
the board of supervisors thereof, on petition of fifty-one per cent. of
the qualified voters of any district, to levy a district road tax in
addition to the levy authorized by general law; provided that the
total levy for district roads, both under general law and this act,
shall not be in excess of $1.85 per $100.00 of the assessed value of
the porperty subject to the tax. [H B 51]

1. Be it enacted by the general assembly of Virginia, That
the board of supervisors of Washington county, whenever re-
quested so to do by (fifty-one per centum of the
qualified voters of any magisterial district thereof, out-
side of the corporate limits of any incorporated town
or towns therein, as in_ section two hereof provided,
Shall be, and are hereby, authorized to levy, in addi-
tion to all levies now authorized by general law, a district road
tax upon the property, real and tangible personal, assessed for
taxation. in such district, and not embraced within the corpor-
ate limits of any incorporated town within such district which
maintains its own streets, which shall be applied to the con-
struction, keeping in order, repairing and maintaining the pub-
lic roads, highways and bridges in such district, provided that
such tax when added to all other taxes levied on property in
the district for road purposes, under general law, shall not
exceed one dollar and thirty-five cents on the one hundred
dollars of the assessed valuation of such property.
2 Whenever a petition signed by fifty-one per centum of
the qualified voters of any magisterial district shall be filed
with the said board of supervisors, requesting the board to lay
an additional levy, as provided in section one, the board, when
it lays its levies under the general law, shall also levy such ad-
ditional tax as may be specified in such petition. The petition
shall be signed by fifty-one per centum of the qualified voters
of the district and shall specify the roads and bridges in the
district which it is desired the said additional tax shall be used
upon and applied to and shall also specify the amount of such
additional tax or levy.
Within fifteen days after the said petition has been filed it
shall be checked by the clerk of the board with the list of
qualified voters at the last preceding November election. If
there be any names signed to said petition of persons who were
not qualified to vote at the last preceding November election
and whose names were not on said voting list, or who have not
come of age and registered since said November election, such
names shall be stricken off. If after any such names are
stricken off there still remains the signatures of fifty-one per
centum of such qualified voters, the petition shall be posted at
the front door of the county courthouse and immediately pub-
lished in one issue of a county paper. Within ten days there-
after any person who claims that he or she did not sign the
petition may come before the clerk of the board, or the county
clerk, and make oath that he or she did not sign it and there-
upon such name shall be stricken off. If within ten days after
the petition is first published in the county papers, and after
such names as last provided, if any, have been stricken off,
there still remains the names of fifty-one per centum of the
qualified voters of the district, signed to such petition, the
board shall, when they next lay the annual levies, levy the ad-
ditional tax in section one hereof provided.
2 Such additional tax, if levied, shall be collected, ac-
counted for and paid out on the warrant of the board as if it
were a county levy, except that the fund arising therefrom
shall be kept separate by the county treasurer, and the fund
shall be expended on the roads and bridges in such district
under the direction of the supervisor of the district.
