Chap. 24.—An ACT to amend and re-enact section 3513 of the Code of
Virginia, as amended by an act approved March 27,1922. [H B 12]
Approved March 20, 1923.
1. Be it enacted by the general assembly of Virginia, That
section thirty-five hundred and thirteen of the Code of Virginia,
nineteen hundred and nineteen, as amended by an act approved
March twenty-seventh, nineteen hundred and twenty-two, be
amended and re-enacted so as to read as follows:
Section 3513. Costs collected of defendant or prosecutor in
criminal case, how disposed of.—All costs in a criminal case, if
there be a judgment for same against the defendant, or the
prosecutor (other than the Commonwealth) shall, when col-
lected, be paid by the officer collecting the same to the clerk of
the court in which the judgment was rendered, or to whom the
justice has certified costs in cases in which costs are not paid
the justice, and shall be paid by such clerk as follows. Such of
the costs as have been allowed and paid out of the State treasury
shall be paid by such clerk into the State treasury, and such
costs as have not been allowed and paid out of the State treasury
shall be disbursed by the said clerk to the several parties entitled
thereto.
This act shall not apply to the fees of an attorney for the
Commonwealth in a felony case except for the prosecution of a
violator of the State prohibition laws. All fees of Common-
wealth’s attorneys for the prosecution of felony cases (except
in prohibition cases) shall, when collected, be paid into the State
treasury.
A justice of the peace, trial justice, or judge of a juvenile and
domestic relations court shall disburse costs collected by him to
the parties entitled to the same.
2. An emergency existing in that the officers throughout
the Commonwealth are hampered in the distribution of costs
eollected in criminal cases, this act shall be in force from its
passage.
All acts and parts of acts in conflict with this act are
hereby repealed.
