in vehicles drawn by animals or propelled by motive power, in, over
or upon the improved public highways or streets within this ee

1. Be it enacted by the general assembly of Virginia, That
hereafter no load hauled in any vehicle drawn by animals or
propelled by motive power, in, over or upon any of the public
highways or streets within this State, shall exceed five tons or
ten thousand pounds in weight, a load of heavier weight may be
hauled where special permit is obtained from the chairman of
the board of supervisors, town or city council or the chairman of
the State highway commission, on the roads or streets under
their respective supervisions. Any person, firm or corporation,
or the agent or servant of any person, firm or corporation, vio-
lating the provisions of this act shall be guilty of a misdemeanor.
But this act shall not be applicable to the highways and streets
in any city the council of which has authority to regulate, by
ordinance, the weights of loads which may be contained in
vehicles drawn or propelled on or over its streets.
